EXECUTIVE SESSION
At 7:00 p.m., Councilman Bianco moved, seconded by Councilman Martorano, to move into Executive Session to discuss the employment of a particular person. At7:15 p.m., Councilman Campisi moved, seconded by Councilman Metz, to move out of Executive Session and proceed with the Work Session.
WORK SESSION
Supervisor Linda G. Cooper called the meeting to order. Acting Town Engineer Sharon Robinson, Highway Superintendent Eric DiBartolo, Planning Director John Tegeder, Assessor Bob Killeen, Deputy Town Attorney John Buckley and Town Attorney Kevin Sweeny were also present.
TAXPAYER REQUEST
Town Attorney Kevin Sweeny spoke about a complaint from a resident who says he mailed his taxes on time, but that the Post Office failed to deliver it on time. The resident was hit with a penalty and is asking the Board to waive it. The Town Attorney explained that while the law does permit a Board to waive penalties under certain circumstances, this is not one of them.
ALTERNATE VETERAN EXEMPTION
Yorktown Assessor Bob Killeen explained that on October 17, 2005, Westchester County approved raising the Alternate Veteran Exemption ceiling from its present full value of $180,000 to $360,000. The Tax impact for the Town would be $36,063 for non combat, $37,916 for combat veterans and $1,392 for those with a disability.
The Town Board agreed to the changes and will advertise a public hearing at its next meeting.
EXCAVATION PERMIT - 2575 COLONIAL STREET
Councilman Metz recused himself from this discussion.
The homeowner, Mr. and Mrs. Mogrovejo explained that they removed trees from the yard in an effort to make a larger play area for their children. They had no idea that the work required any type of permit. The Town Board suggested that the homeowners contact an environmental planner who can come up with a remediation plan. The Town Clerk will supply the applicant with names of environmental vendors.
Councilman Metz returned to the meeting.
SELF-STORAGE AT STAPLES PLAZA
John Tegeder, Director of Planning stated that the owner has asked if he could use space at the bottom of his complex for self storage. There were no objections to this. Mr. Tegeder will work with the Town Attorney to amend the code to allow self storage with this property use.
ENVIRONMENTAL PLANNING DISCUSSION
There was discussion between the Town Board and the Director of Planning as to what responsibilities would be associated with this position. The Planning Director will draw up an RFP and circulate amongst the Town Board members before sending it out to environmental firms.
COMPREHENSIVE PLAN REZONING
Mr. Tegeder went over various amendments to the zoning code as well as possible zone changes which had been identified in the comprehensive plan. The code changes will be advertised at the next meeting for public hearing. The Planning Department will set up an informational meeting for owners of those properties which are proposed to be rezoned.
HUNTERBROOK SEWER DISTRICT
Mr. Capellini, attorney for Mr. Martinez explained that the property is in the Peekskill Sanitary District. The expenses for this local district will be borne by the developer.
POSSIBLE OPEN SPACE PURCHASES
Discussion concerning property located at 3434 Stony Street and 3211 Lake Shore Drive. The consensus was that no open space money should be used for these properties.
JEFFERSON VILLAGE DRAINAGE PROJECT
Representatives of RGI Properties, the management agent for Condo 9 and JOC, their Engineer, Dan Ciarcia explained that the project started out as a submission by Condo 9 but now includes property owned by the Town of Yorktown and property owned Jefferson Owners Corporation. The purpose of this project is to divert surface water runoff received from property owned by the Town of Yorktown. There will be three phases to this project. During phase one, Jefferson Owner’s Corporation will rehabilitate an existing drainage channel. During the second phase of this project, an inlet will be built to bring water flowing from property adjacent to Jefferson Village to the rehabilitated water channel. Phase three of the project will be paid for by the Town
of Yorktown and will create the diversion channel to collect runoff from the property owned by the Town.
Since the project has changed from the original submission, the applicant will have to submit a new application and it will be referred out.

MISCELLANEOUS
Cable Update: Councilman Bianco explained that the Cable Committee is working with Emilie Spaulding on various issues including updating the public access studio.
Villas on the Lake Condos - Town Attorney Kevin Sweeny stated the Condo’s attorney has asked that the late fees be waived. He stated that the old Management company should have paid the bills on time. The Town Board stated that it would not waive these fees.
Lakeside Colony delinquent water bills - The bills must be paid
Vijacki - The Town Board was told of the defective water meter which caused the homeowner’s bill to rise dramatically. The Board accepted that the cause of the rising bill was due to a break on the Town’s side of the water line.
