EXECUTIVE SESSION
At 7:00 p.m., Councilman Bianco moved, seconded by Councilman Campisi to move into Executive Session to discuss the employment of a particular person and to discuss contract negotiations with the PBA.
Councilman Bianco moved, seconded by Councilman Campisi to move out of Executive Session and proceed with the Work Session.
WORK SESSION
Supervisor Linda G. Cooper called the meeting to order. Town Attorney Kevin Sweeny was also present.
HOLLAND SPORTING CLUB, DECATUR ROAD
Planning Director John Tegeder, Parks and Recreation Superintendent Jennifer Fava and members of the Recreation Commission spoke about the need to hire Walter Sedovic, architect, to complete condition survey and feasibility study on the Holland Club.
Mr. Tegeder handed the members of the Board a copy of a letter written by Jill Fisher a representative of Larson Fisher Associates, Inc, the Historic Preservation and Planning Company currently working on a Reconnaissance Level Historic Resources Survey for the Town of Yorktown. In that letter, she suggests that no action be taken on the property until the history of the property is documented, a conditions assessment be made on the buildings to determine their structural integrity, their design condition, their adaptability to new uses, and the extent of the renovation that would be required.
Supervisor Cooper stated that the Town has already created a capital budget project for this park. She would not like to see this money come from the general fund.
Councilman Campisi stated that this issue was brought to the attention of the Building Inspector who told us that it would cost one million dollars to bring the plumbing and electrical up to code.
Supervisor Cooper stated that she would to see the Recreation Commission convene hearings with stakeholder groups to get other opinions.
Councilman Metz asked if this work could be done by in house personnel. What about using the Building Inspector and the Landmarks Commission?
The issue will be placed on the next Town Board agenda.
BALLFIELD FENCING UPDATE
Superintendent Fava gave an update on the ballfield fencing problem. After finding out that the footings for these fences were buried two feet instead of the four feet which the specifications call for, the company came up with a way to resolve the problem which allows the two foot footings to remain in the ground. The Deputy Town Engineer does not agree with this method and believes the bid specifications should be complied with.
Ms. Fava stated that she held back the final payment of $24,935.69.
Councilman Campisi stated that he wanted the job done correctly, or we keep the final payment, plus go after the Performance Bond.
Jim Hackett, the Chairman of the Recreation Commission stated that there is also another problem. The contractor damaged eight fields while doing this work. The contractor will repair the fields, if we give him his final check. If the town did the work, it requires 240 hours of manpower.
There was discussion on giving the fencing company money as they repaired each field.
VOLUNTEER POOL PASSES
The Town Board will no longer give free pool passes to members of voluntary boards. The volunteer will now have to pay for half of the pass.
ENVIRONMENTAL PLANNING PROPOSALS
Yorktown Planning Director John Tegeder stated that he the interviews for this position will take place on Monday, April 3.
The Board spent a considerable amount of time debating the responsibilities of this position. In the end, the one thing they all agreed upon was that the Town does need someone for wetland delineation and verification. The Board will decide whatever duties are necessary during the interviews.
The Board did agree to permit the Chairman of the Conservation Board and the Planning Director sit in on the interviews.
COMPREHENSIVE PLAN RE-ZONINGS AND LAWS
John Tegeder spoke about a possible schedule for these rezonings beginning with an informational meeting in Town Hall on a Saturday.
Discussion on whether the Board agreed to go from two to five acres on Hog Hill Property as well as the Trump Property.
Discussion on whether to upzone the Hog Hill Property. The owner has already presented an application for a rezoning to senior housing.
Town Attorney Sweeny explained that the Board could upzone the property, but in its plan for the area state that it would consider this property as a place it would like to see senior housing. In the event that the developer walks away, this property would not be left at its present
two acre zoning.
STREAM TEAM
Supervisor Cooper handed the Town Board a scheduled of the areas proposed for drainage work this summer including Georgian Estates, Mill Pond, Shrub Oak Brook, Barger Brook, Mohegan Outlet and maintenance in the crossroads area.
The work will be done by college students under the supervision of the Highway Department.
A grant will pay for the work.
FAVIA
Acting Town Engineer Sharon Robinson stated that residents of Jefferson Village complained that the owner of property at 3435 Munson Place was in violation of our environmental laws because he added a shed to the property near a wetland without getting a permit.
Mrs. Robinson explained that in addition to speaking to the resident who told her that he replaced an existing shed on his property. 2001 aerial photographs over this home show a shed on the property at the time in which he brought the property. It has also been factually proven that a shed has been on the property since 1969. There has been no evidence of excessive clearing of the land near this shed. She further stated that this replacement shed does not add any adverse impacts to the buffer.
