TOWN BOARD MEETING
        Supervisor Linda G. Cooper called the meeting to order.
                
        
PROCLAMATION
        Supervisor Cooper read the following proclamation:

        WHEREAS historic preservation is an effective tool for managing growth, revitalizing neighborhoods, fostering local pride and maintaining community character while enhancing livability;  and

        WHEREAS historic preservation is relevant for communities across the nation, both urban and rural, and for Americans of all ages, all walks of life and all ethnic backgrounds; and

        WHEREAS it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals in helping to preserve the tangible aspects of the heritage that has shaped us as a people;  and

        WHEREAS “Vision, Economics and Preservation” is the Theme for National Preservation Month 2006, cosponsored by the Yorktown Historical Society and the National Trust for Historic Preservation.

        NOW, THEREFORE, I,  LINDA G. COOPER, Supervisor of the Town of Yorktown, along with the Town Board, do hereby proclaim the month of May 2006 as National Preservation Month  and call upon the people of Yorktown to join their fellow citizens across the United States in recognizing and participating in this special observance.

            Mr. Thomas Travis, President of the Yorktown Historical Society and Co-Chair of the Yorktown Landmark Commission, Monica Doherty past President and Program Chair of the Historical Society along with Adele Hobby, Assistant Curator of the Yorktown Museum accepted the Proclamation and spoke about their organizations.  Mr. John Tegeder, Director of the Planning Department also spoke about a historic survey of Yorktown which is currently underway.  The consultant for this project has stated that Yorktown has more historic structures than he previously thought.


APPOINTMENT
REAL PROPEERTY APPRAISER - KIM PENNER

        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        BE IT RESOLVED, that Kim Penner is hereby appointed Real Property Appraiser effective May 1, 2006 from Eligible List No. 77-020 to be paid from Yorktown CSEA Salary Schedule A-1, Group 12, Step 2 which is $55,745 annually.

        BE IT FURTHER RESOLVED, that this appointment is subject to a probationary period of not less than 12 nor more than 52 weeks.

APPOINTMENT
SEWER TREATMENT MAINTENANCE WORKER
MICHAEL CARDUCCI
RESOLUTION #233
        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        BE IT RESOLVED, that Michael Carducci of Putnam Valley, New York is hereby appointed Temporary Sewer Maintenance Worker at the Wastewater Treatment Plant effective June 5, 2006 to be paid from Yorktown CSEA Salary Schedule A, Group 10, Step 5 which is $52,227 annually, representing no change in salary.

CARRY-OVER VACATION
LIBRARY - MARIA STOLFI
RESOLUTION #234
        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        BE IT RESOLVED, that Maria Stolfi of the Library, is hereby authorized to carry over one vacation day from 2005 to 2006.

APPOINTMENT
PLANNER - ROBYN STEINBERG
RESOLUTION #235
        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        BE IT RESOLVED, that Robyn Steinberg is hereby provisionally appointed Planner (Planning) effective May 1, 2006 to be paid from Yorktown CSEA Salary Schedule A-1, Group 17, Step 1 which is $67,550 annually.

             Mr. John Tegeder, Director of Planning introduced Robin Steinberg who he says was Robin Prestamo when she joined his staff three years ago.  He said Robin has helped his department to grow and extended their capabilities.

             Robin Steinberg thanked the Town Board for her promotion.  Within the next couple of months she will have an updated zoning map for the Town Board to sign.               


APPOINTMENT
LIBRARY BOARD - AUDREY SHERMAN
RESOLUTION #236
        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        BE IT RESOLVED, that Audrey Sherman of Yorktown Heights is hereby appointed to the Library Board for a five year term expiring on August 31, 2010.

        Resolution adopted.
        
             Supervisor Cooper stated that Mrs. Sherman previously served on the Library Board from 1988 to 1998.  She is an experienced scientist and technical writer.       
                        
        Mrs. Sherman thanked the Board for this vote of confidence in her abilities to work on the Library Board.

              Supervisor Cooper accepted the retirement of Connie Werner who works in the Yorktown Police Department with regret.  Mrs. Werner has worked in the Records Department of the Police Department for twenty two years.  


PRESENTATION                                                            
               Mr. John Dillon, a Commissioner for the Yorktown Advanced Life Support District gave an overview as to how the district has evolved.

                 The Yorktown Volunteer Ambulance Corp was started in 1963.  In the northern area of Town, the Mohegan Ambulance Corp performs the same service.  Both services transport sick individuals to the hospital.  Each service has three ambulance.  When the Advanced Life Support District (ALS) was formed, the town went from providing basic life support to advanced life support.
                
               In 1993, the Yorktown Volunteer Ambulance Corp (YVAC) and Empress developed a pilot program to show the effect of having advanced life support in this community, In July, 2003, the Advanced Life Support District was created as a funding mechanism for this service.  In addition to having EMT’s who perform basic life support services, we have paramedics who perform services similar to those in emergency rooms.  We also participate in the county wide advanced life support district which has a mutual aid component.  The cost of this service to the average property owner is about $30.00.  

               Mr. Daryn Baia, a liasion to the ALS District from Empress Ambulance stated that last year, we responded to more than 2400 requests for help of which represents a twenty percent rise in calls over 2004.  Empress will be offering a program to train town employees in CPR and in the use of the defibrillator.

           DURING HER REPORT TO TOWN,  SUPERVISOR LINDA G. COOPER stated that the intersection of Routes 202 , 35 and 118 will be closed through tomorrow morning so that the construction of the right hand turn lane can continue.  She further explained that this is a multi tiered project with improvements such as new landscaping and sidewalks coming to other parts of the intersection during the next year.  Supervisor Cooper also discussed a new mailer sent out by the Coalition for Drug Free Youth which urges parents and/or guardians to talk to their children about the use of alcohol and drugs.  She stressed the importance of her message by stating that a youngster in middle school was led away in handcuffs for smoking marijuana in school.
        
            Councilman Martorano congratulated the committee on the publication of this brochure and stressed the seriousness of the information inside.

             Supervisor Cooper ended her Report to the Town by stating that the Simon Property Group has issued a Code of Conduct for the Mall.   The advisory states that they will ask any unsupervised youth who is just hanging around the Mall to leave.  The Mall will provide a phone for these youngsters to call for a ride and a place for them to wait until they are picked up.  They will not be allowed to continue to just walk around the mall.
                        
                                                                
DURING COURTESY OF THE FLOOR, the following residents addressed the Town Board:

           Mr. Roland Faucher a member of the Westchester EMS Council stated that former Councilwoman Barbara Wilkins will receive their Volunteer of the Year Award.  She has volunteered with YVAC since its beginning in 1963.
                        
            Mrs. Linda Clemenza stated that she attended the last meeting of the Zoning Board of Appeals where the Comprehensive Plan was challenged by members of that Board.  Councilman Nicholas Bianco was in the audience and explained reasons for the adoption of various portions of the plan.  This was an unfortunate situation which became rather heated.  Mrs. Clemenza stated that too many people spent too many hours working on this plan to see it eroded by members of the Zoning Board of Appeals.

            Supervisor Cooper stated that the Town Board will be meeting with the members of the ZBA shortly to give them the tools they need to interpret the plan.


PUBLIC HEARING
PROPOSED LOCAL LAW AMENDING SECTION 275-6
        Supervisor Cooper called to order a public hearing to amend Chapter 275, Section 275-6 of the Code of the Town of Yorktown by adding to the list of public streets upon which a driver of a vehicle shall come to a full stop unless otherwise directed by a peace officer, the following:

        Spruce Street - at the northwest corner of the intersection with Ivy Road

           Councilman Metz stated that historically the only way we could slow down traffic in a given area was by the use of stop signs.  Today our Neighborhood Traffic Calming Program contains a variety of methods including speed humps and speed tables.  He asked Councilman Campisi to explain the reason for the first portion of this proposal which is to add stop signs on Spruce Street.

          Councilman Campisi explained that the stop sign which is currently in the area was placed there when there was only one development.  Since that time, a new subdivision has been built.  This additional stop sign will be placed at the intersection opposite the current stop sign.

           Councilman Metz explained in the second portion of the proposal is to add a four way stop at Quinlan and London.  

            Supervisor Cooper explained that something has to happen.  We need to slow down traffic in the area.  But, she is not sure that stop signs will work.  She suggested that maybe a speed table could work.  The Supervisor would like to see something done quickly.  We could analyze how well it worked, and then look at other options.
            
            Councilman Campisi agreed with the Supervisor that a stop sign is probably not going to work.  But, he wanted to hear ideas from the public.
 
             Mr. Carl Tomanelli, a resident if Quinlan Street stated that he has been living in his home for more than thirty three years.  He is concerned with the effect of stop signs during inclement weather.  Cars already have trouble getting up the road when it is dry and sunny.   A stop sign would only cause more problems.  Mr. Tomanelli further stated that one of the keys to making this area safe is enforcement of the current laws.

            Mrs. Martha Tomanelli, a resident of Quinlan Street stated that her street is the gateway to the Mall.  Hundreds of cars pass her home each day, many of them are barely able to make it up the incline.  She urged the Town Board not to reject the proposal.

           Mrs. Linda Clemenza also spoke against stop signs saying that contractors routinely drop building materials onto the roadway which further adds to the problems that already exist in the area.  She further stated that the intersection of Granite Springs Road and Quinlan Street is also hazardous.

           Councilman Campisi stated that the intersection is hazardous because Colonial Street does not match up with Quinlan Street.

        All those present having been given the opportunity to be heard and there being no further discussion the hearing was closed.   Councilman Metz motioned, seconded by Councilman Campisi.                                                               
        

CHAPTER 276-6 ADDITION OF FULL STOPS
LOCAL LAW #6 - 2006

        Upon motion made by Councilman Metz, seconded by Councilman Martorano,                                                                                  
        WHEREAS a public hearing was held on the 2nd day of May, 2006 pursuant to notice duly published as required by law to consider the adoption of a proposed Local Law amending Chapter 275-6 of the Code of the Town of Yorktown by adding to the list of public streets upon which a driver of a vehicle shall come to a full stop unless otherwise directed by a peace officer, the following:

        Spruce Street - at the northwest corner of the intersection with Ivy Road
                
        RESOLVED, that Local Law #6 of the year 2006, as annexed hereto, be and is hereby adopted.
                                
        The question of the adoption of the foregoing Local Law was duly put to a vote on roll-call, which resulted as follows:

NOTICE TO BIDDERS
PURCHASE OF SEWER JET TRUCK

        Upon motion made by Councilman Martorano, seconded by Councilman Campisi,

        Sealed proposals will be received by the Town Clerk of the Town of Yorktown, Westchester County, New York, at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York, until 10:00 a.m., on Monday, June 5, 2006, for the Purchase of a Sewer Jet Truck for the Water Pollution Control Plant (WPC), Capital Improvement Project #06-3.
             
        Plans, Specifications and standard proposals for the work proposed may be obtained at the office of the Town Clerk at said Town Hall upon cash or certified check of TWENTY-FIVE DOLLARS ($25.00).  Said fee will not be refunded and will be used to defray costs of printing plans and specifications.  

        All bids must be accompanied by a Certified check payable to the Town of Yorktown in an amount not less than ten percent (10%) of the total bid, or an executed Consent of Surety.

        The bidder assumes the risk of any delay in the mail or in the handling of mail by the employees of the Town of Yorktown.  Whether sent by mail or means of personal delivery, the bidder assumes the responsibility for having bids in on the time and the place specified above.

        The Town of Yorktown reserves the right to waive any informalities in the bids, to reject any or all bids and reserves the right to accept that bid which it deems most favorable to the interests of the Town of Yorktown.  No bidder may withdraw his bid within thirty (30) days after the actual date of the opening thereof.

        Bids were received and opened on April 17, 2006 at the Town Hall for Removing/Replacing Bricks and Sand at the Yorktown Police Station/Courthouse.  After review of said bids, all were rejected and the project is to be rebid.

        Specifications may be obtained at the office of the Town Clerk in said Town Hall.

        Upon motion made by Councilman Martorano, seconded by Councilman Campisi,

        NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of May, 2006 at 7:30 o’clock PM, or as soon thereafter as the same can be heard, to consider the application of Schoor DePalma for a wetland permit for property located at 738 East Main Street, Section 16.07, Parcel 1, Lot 37, Shrub Oak.  Described work, demolition of an existing abandoned house, construction of a new single-family dwelling and activity in wetland and buffer to construct a new driveway to Town standards.

        NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of May, 2006 at 7:30 o’clock PM, or as soon thereafter as the same can be heard, to consider the application of Jonette Ober for a wetland permit for property located at 2759 Springhurst Street, Yorktown, NY 10598.  Described work is fill back slope with clean fill, install retaining wall at bottom of slope to control runoff, fence backyard for safety, and removal of three trees on slope.

        Upon motion made by Councilman Martorano, seconded by Councilman Campisi,

        NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of May, 2006 at 7:30 o’clock PM, or as soon thereafter as the same can be heard, to consider the application of Francesca Samsel for a variance for property located at Hunterbrook Road, Section 47.05, Block 1, Lot 13.  The applicant is seeking a variance of the 10% limitation on driveway grades so as to enable the installation of a common driveway serving two lots, portions of which driveway are at a 14% grade.

        A copy of said proposal is on file in the Office of the Town Clerk, at the said Town Hall, where the same may be inspected during regular office hours.

        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        WHEREAS, Michael Dubovsky, as applicant, provided the Town with Check No. 0720922, in the amount of $12,000.00 to serve as the Erosion Control Bond  for the Michael Dubovsky Site Plan, for work being performed on Route 118, NOW, THEREFORE BE IT

        RESOLVED,  that Check No. 0720922, in the amount of $12,000.00, be and is hereby accepted to serve as the required bond for the Michael Dubovsky Site Plan.

EXCAVATION PERMIT APPLICATION
FEE RELEASE - OLNEY #E-018-06

        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        WHEREAS, Katherine Olney, as applicant, heretofore paid a $40.00 application fee for a Excavation Permit which was deposited into the A2116 account on April 24, 2006, and,

        WHEREAS, it was determined by the Environmental Panel that an Excavation Permit will not be needed for the scope of work Ms. Olney is doing,  NOW THEREFORE BE IT,

        RESOLVED, that the above-referenced fee be released to Katherine Olney, 867 Kitchawan Road, Ossining, NY 10562.

AUTHORIZATION TO SIGN SNAP AGREEMENT

        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        RESOLVED, the Supervisor is hereby authorized to sign the Supplemental Nutrition Assistance Program (SNAP) Agreement for the period April 1, 2006 through March 31, 2007 in the amount of $4,376.00.

OPPOSITION TO FEDERAL LEGISLATION
REGARDING VIDEO AND CABLE SERVICES
RESOLUTION #246
        Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        WHEREAS, local governments are legally and ethically obligated to control and charge for the use of rights of way;

        WHEREAS, local governments engage in a variety of activities related to rights of way to protect the public safety and welfare, to prevent conflicts between public rights of way users thereby minimizing service disruptions to the public, to protect public investments in rights of way, to protect consumer interests and the needs of the community;

        WHEREAS, each local community has its own distinct communications needs and local elected officials are best positioned to identify those needs;

        WHEREAS, emergency first responders and local government workers require well build, high quality communications networks;

        WHEREAS, local communities have unique consumer concerns and local elected leaders are best able to respond quickly to those concerns by tailoring consumer protection rules in order to fit their needs;

        WHEREAS, local elected leaders are committed to the fair and equitable treatment of all people no matter their race, ethnicity, or income and are dedicated to efforts that prevent economic redlining and other activities that increase the digital divide;

        WHEREAS, local governments seek to encourage public access to government information and decision-making and to provide its community with the capacity for advanced communications services;

        WHEREAS, the continued development of a globally competitive information, video, and cable service delivery systems should result in competitive consumer costs for basic services and provide expanded services for consumers;

        WHEREAS, local government supports treating like services alike and Congress is considering legislation to treat Internet Protocol based services differently from other similar services;      

        WHEREAS, public safety, health, public welfare, and consumer protection is managed through the franchise process overseen by local governments;

        WHEREAS, public rights of way are to be managed by local government on behalf of the public;            

        WHEREAS, Congress is now considering legislation on the provision of video, voice, and data services and it may limit or abolish cable franchises with proposals to replace them with a national franchise;

        WHEREAS, limiting or abolishing local cable franchises could violate local property rights and principles of Federalism by taking portions of the streets and rights of way for providers’ lines without the agreement of the municipality in question, without adequate opportunities to tailor the franchise and services to meet local needs, and without the provisions in cable franchises necessary to protect the municipality, the public, and customers; and

        WHEREAS, legislation removing or limiting the revenue municipalities currently receive from the preceding types of providers for usage of the public streets would cost this nation’s municipalities over $2 billion per year, and would have a severe financial impact on municipalities at a time when both state and Federal funds for municipalities are being cut.

        NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Yorktown supports the continued requirement for providers of video services using the public rights of way to obtain local franchises, whether that provider is a cable company, a telephone company, or some other entity;

        BE IT FURTHER RESOLVED that the Town Board of the Town of Yorktown strongly endorses promoting competition for all consumers and treating like services alike and is willing to work with newcomers in the video market in order to provide an efficient franchise process that will not obstruct new service deployment;

        BE IT FURTHER RESOLVED that federal legislation should not prevent municipalities:

       from requiring broadband, cable television or telephone providers who use the rights of      way to obtain a local franchise or other local permission for such use;
       from being fairly compensated for such use;
       from maintaining local control and management of the rights of way;
       from preventing redlining or other discriminatory practices; and
       from ensuring appropriate consumer protections.

        BE IT FURTHER RESOLVED that the Town Board of the Town of Yorktown opposes legislation which would limit or restrict the obligation of providers offering Internet Protocol based video services to obtain local cable franchises, or legislation which would impose other restrictions relating to such providers with respect to the rights of local government to manage their rights of way, be fairly compensated for its use, provide needed protections for the municipality, the public, and ensure that local needs are met.

RE-APPROVAL OF SITE PLAN - TEMPLE ISRAEL
RESOLUTION #247
Upon motion made by Councilman Metz, seconded by Councilman Campisi,

        WHEREAS a formal application for the approval of a site plan and architectural plans titled “Temple Israel of Northern Westchester,” as prepared by Cronin Engineering, P.E., P.C., dated November 17, 2004 and last revised December 22, 2004 and Gershon Palevski, R.A., dated June 12, 2004 and last revised November 16, 2004, and as located on Section 36.06, Block 2, Lot 72 (f/k/a Section 8.11, Parcel 6, Lot 9) of the Town tax map (“the Property”), was submitted to the Planning Board on January 7, 2005; and

        WHEREAS said site plan was approved by the Town Board by a resolution dated June 7, 2005; and           

        WHEREAS said resolution expires June 2, 2006; and

        WHEREAS the Town Board finds there has been no change in the environmental findings leading to the approval of the subject site plan based on the correspondence of the applicant’s attorney dated April 18, 2006;

        BE IT FURTHER RESOLVED that the Town Board resolution approving the site plan for Temple Israel of Northern Westchester is hereby re-approved in its entirety; and

        BE IT FURTHER RESOLVED that the Town Board resolution approving the application for a wetland permit (#WP/E-041-05) is hereby re-approved subject to the requirements and conditions contained therein; and

        BE IT FURTHER RESOLVED that the Town Board resolution approving the application for an excavation permit (#WP/E-041-05) is hereby re-approved subject to the requirements and conditions contained therein; and

        BE IT FURTHER RESOLVED that unless a building permit, extension, or re-approval has been issued within 360 days of the date of this resolution, or by May 28, 2007, whichever is later, the foregoing re-approvals will be null and void.

AUTHORIZATION FOR DEC TO PICK UP
REFUSE AT YORKTOWN FIREHOUSE
RESOLUTION #248
        Upon motion made by Councilman Martorano, seconded by Councilman Campisi,

        BE IT HEREBY RESOLVED that the Town Board authorizes the Yorktown Environmental Conservation Department to collect garbage and refuse from the dumpster adjacent to the Yorktown Firehouse at 1916 Commerce Street in accordance with a schedule and terms determined by the Superintendent of the Environmental Conservation Department.

        RESOLVED, the Supervisor is hereby authorized to sign the Justice Court Assistance Program 2006 Grant Application.
