Police Chief McMahon spoke about both police officers. He stated that Officer Sansone has lived in the Town of Yorktown for ten years. In July, 2004 he became a New York City Police Officer working at the 46th Precinct in the Bronx. Officer Sansone is a paramedic certified in CPR and in critical care treatment. Officer Mundy and his wife have lived in the Town of Yorktown for over five years. He received his Bachelor of Science Degree from SUNY Brockport in Communications. Officer Mundy is currently working on his Master’s Degree in Public Administration. In 2005, he joined the New York City Police Department working at the 44th Precinct in the Bronx. He is certified in CPR and in
Weapons of Mass Destruction.
Officer Sansone and Officer Mundy both thanked the Town Board for giving them the opportunity to serve the community they live in.

Police Chief McMahon stated that Ms. Garretto will put her experience of working with CEO’s and CFO’s of major corporations to use in the Police Department.
Ms. Garretto explained that while she has never worked in the public sector, she will put her vast knowledge of experience to work in the Town of Yorktown.
Police Chief McMahon presented a Certificate of Appreciation from the Police Department to Police Surgeon Jose Garcia who is retiring after twenty five years of service. The position of Police Surgeon was created during the mid 1970's by the Town Board. Dr. Garcia had already been serving as the unofficial police surgeon for several years.
Former Police Chief Robert Arruda paid tribute to Dr. Garcia.
Former Police Lieutenant Anthony Masi stated that there are no words that could express his appreciation when it comes to Dr. Garcia. He thanked the Town Board for recognizing a gentleman who he says served with “distinction.”
Dr. Garcia thanked the Town Board for allowing him to continue to serve in this capacity with the Yorktown Police Department who he says is the best police department in Westchester County.

Councilman Bianco explained that SUPERVISOR LINDA G. COOPER left him a copy of her REPORT TO THE TOWN. June 16th - June 17th is the Relay for Life which will be held at the track behind the Yorktown Community and Cultural Center. The Elks will hold its annual Flag Day observance on June 14th in the Senior Room of the Yorktown Community and Cultural Center. The John C. Hart’s Summer Reading Club began on June 1st. Two groups have joined the Adopt a Road Program. Cub Scout Pack 165 has adopted a one mile area around Junior Lake. The Gay Ridge Homeowners Group have adopted an area off Route 6 near Somerston Road.
DURING REPORTS FROM THE TOWN COUNCIL, Councilman Louis Campisi announced that the Westchester County Clerk, Tim Idoni will have his mobile van outside of Town Hall on Monday, June 12th.
DURING COURTESY OF THE FLOOR, the following residents addressed the members of the Town Board.
Alexander Sverdlov, a resident of 3499 Stony Street spoke about his neighbor who he says has nine dead trees on his property. The Town Code Enforcement Officer came out and told him that the trees appear to be dead and could be harmful to him if they fell. But, Mr. Hughes also explained that the current Town Code doesn’t have any provision which would allow him to summons the homeowner.
Diane Maddock, a resident of 1365 Leland Drive stated that she has placed the home that she has lived in for 38 years on the market. Unfortunately, her neighbor’s home looks like a junkyard. The Code Enforcement Officer has been out and has summons the neighbor for some of what is outside that home. But, he says the code does not address items like washing machines along the side of their home.
Victoria Gunther, a resident of 2813 Larkspur Street complained that she is in septic failure but is unable to get hooked into the Hallock’s Mill Sewer District.
Mr. Howard Frank, a resident of Curry Street representing the United Taxpayers of Yorktown spoke about the Town’s Water Report which is issued annually by the Yorktown Consolidated Water District. He stated that the quality of the water is excellent, but the report fails to include a lot of financial data. Mr. Frank stated that because this report shows a 20% loss of water by the District, and no data explaining how the water was lost, the UTY has foiled the information. He also stated that although the Town of Yorktown regularly coats and paints the inside of the water tanks on Quinlan Street, the outside appears to be rotting. Mr. Frank stated that they are suppose to be sitting on slabs of concrete, instead they appear be sitting in water.
Mr. Anthony Grasso thanked the Town Board for his appointment to the Advisory Traffic Committee. He also stated that he was happy to see the appointment of two new police officers. Mr. Grasso stated that what concerns him is the fact that out of five members of the Board, only three are here tonight. He says if a politician is voted into a particular office and decides to run for a different office, he should wait until his term of office ends.
Mr. Nick DiTomasso spoke about a letter he wrote to the North County News in 2005 which he says is similar to a recent Editorial by Supervisor Cooper. Both newspaper articles addressed the price of freedom which they say isn’t free. He thanked Supervisor Cooper for her thoughts.
Mr. Dennis Horbatuk, a resident of Mohegan Lake spoke about the recent Zoning Board of Appeals meeting which he said was very frustrating. He says people are purchasing sub-standard lots with an eye toward getting a variance to build homes on them. This he says is happening because when the sewer district was built, hookups were placed on these lots. Mr. Horbatuk later asked, that the Town Board when it considers writing laws to protect the environment, write them in a way that leaves nothing open to interpretation.
Mr. Steven Scadaferri echoed the sentiments of Mr. Horbatuck. He further stated that the laws already on the books such as our freshwater wetlands law should be strictly enforced.
Councilman Bianco addressed many of the concerns of the residents who appeared before the Town Board. He told Mr. Sverdlov who was a New York City Code Enforcement Officer that he would like to see the law that New York City would use to cite someone like his neighbor with a violation. He explained to Mrs. Maddock that he and the other members of the Board would come out to her home and see if there is anything else that could be done using the present code. Councilman Bianco explained to Mrs. Gunther that the Town is already under court order regarding the Hallock’s Mill Sewer District. He said the plans to upgrade the facility are currently being drawn up. Councilman Bianco explained that he was at the last ZBA meeting
and shares Mr. Horbatuk’s frustration. But, the Zoning Board of Appeals gets it powers from state law. The Town Board has nothing to do with the exception of the appointment of these volunteers.
PUBLIC HEARING
SCHOOR DEPALMA REQUEST FOR WETLANDS PERMIT
Councilman Bianco convened a public hearing to consider the application of Schoor DePalma for a wetland permit for property located at 738 East Main Street, Section 16.07, Parcel 1, Lot 37, Shrub Oak. Described work, demolition of an existing abandoned house, construction of a new single-family dwelling and activity in wetland and buffer to construct a new driveway to Town standards. The Town Clerk presented affidavits of posting and publication.
Mr. Paul Berte, the engineer for the applicant stated that the wetlands permit will permit the reconstruction of an existing single family home. The only disturbance to the wetlands will be to the buffer for the construction of a driveway.
Councilman Bianco asked the Town Clerk if any reports had been received.
She stated that the Conservation Board, the Town Engineer and the Planning Board support this application because the footprint of the building has been pulled out of the wetlands.
A resident living at 760 E. Main Street had several questions including whether the current stone wall that separates the two properties would remain and if there would be any blasting associated with the demolition of the existing house.
Mr. Berte stated that the stone wall would remain and that there would be no blasting associated with this work.
The resident also asked that the applicant do all he could if rodents were disturbed during the demolition.
Mr. Berte explained that there shouldn’t be a rodent problem, but if there was, his client would put down traps.
All those present having been given the opportunity to be heard and there being no further discussion the hearing was closed. Councilman Campisi motioned, seconded by Councilman Metz.
SCHOOR DEPALMA - REQUEST FOR WETLANDS PERMIT
RESOLUTION #293
Upon motion made by Councilman Campisi, seconded by Councilman Metz,
WHEREAS, the Town Board of the Town of Yorktown has received from Schoor DePalma, Inc. (the “Applicant”) an application (#WP-070-05) for a wetlands permit to allow demolition of an existing abandoned house, construction of a new single-family dwelling and activity in wetland and buffer to construct a new driveway to Town standards on property located at 738 East Main Street, Shrub Oak; and
WHEREAS, the proposed activity will occur in wetland and wetland buffer areas; and
WHEREAS, the Applicant’s property is identified on the tax map of the Town of Yorktown as Section 16.07, Parcel 1, Lot 37; and
WHEREAS, the Town Board of the Town of Yorktown has previously made the following determination:
1. That the Proposed Action requires SEQRA review;
2. That the Proposed Action is Unlisted;
3. That the Town Board wished to assume Lead Agency status in connection with the SEQRA review of the Proposed Action; and
WHEREAS, the Town Board declared, and circulated a declaration of, its intent to act as Lead Agency in connection with all processing, procedures, determinations and findings to be made or conducted with respect to the Wetlands Permit application under Section 8-0101, et. seq. of the Environmental Conservation Law (“SEQRA”) and the regulations promulgated by the New York State Department of Environmental Conservation thereunder , which appear at 6 N.Y.C.R.R. Part 617.6(b) (the “SEQRA” Regulations); and
WHEREAS, no involved agency challenged the Town Board’s lead agency status; and
WHEREAS, said application was circulated for review and comments to the New York State Department of Transportation, the Town Engineering Department, the Town Conservation Board, the Town Planning Board and the Town Environmental Code Inspector; and
WHEREAS, the Town Board received comments from the Town Engineering Department, the Town Conservation Board, the Town Planning Board and the Town Environmental Code Inspector; and
WHEREAS, the Applicant has submitted an appropriate Environmental Assessment Form (EAF) which has been satisfactorily reviewed by the Town’s Environmental Code Inspector and the Conservation Board; and
WHEREAS, a public hearing was convened on the 6th day of June 2006, at 7:30 o’clock PM, during which public hearing the Applicant presented information and arguments in favor of granting the permit and members of the surrounding neighborhood and the public at large were afforded the opportunity to present information and express their views concerning the application; and
WHEREAS, the Town Board finds that the Applicant’s plans, as revised to incorporate recommendations of the Engineering Department, the Conservation Board, and the Environmental Code Inspector, minimize potential environmental impacts; now therefore be it
RESOLVED, the Town Board, as lead agency, has determined that the Proposed Action described above will not have a significant adverse environmental impact and a Draft Impact Statement will not be required; and be it further
RESOLVED, that the Applicant’s Wetlands Permit application is approved subject to the following conditions:
1. Applicant must submit to the Town Engineer written verification that any and all New York State Department of Environmental Conservation (NYSDEC) (including Phase II), New York City Department of Environmental Protection (NYCDEP) and Army Corp of Engineers (ACE) requirements (as applicable) have been met and all permits required for this application have obtained prior to commencement of work.
2. Prior to the issuance of a building permit, the wetland permit application and EAF must be amended to reflect the most current plan revision date and the language of the permit must reflect the plan.
3. Prior to the issuance of a building permit, the applicant must submit to the Town the letter from the owner of the property authorizing the applicant to apply for the wetland permit on their behalf.
4. A storm water pollution plan must be prepared in compliance with the Town’s Stormwater Ordinance. This plan must be approved by the Town Engineer prior to the
commencement of any work on the site. If the area of disturbance is calculated to be greater than one acre, a NYSDEC Phase II stormwater permit will also be required and the Notice of Intent (NOI) must be submitted to the Town Engineer prior to the commencement of work. Stormwater volume must not exceed pre-construction levels.
5. Hay bales as shown as shown on the above-referenced plans must be changed to stone check dams to the approval of the Town Engineer.
6. Southerly stormwater basin must be modified to accommodate additional stormwater volume and the overflow/outlet pipe (outlet structure) must be connected to the existing swale on the southern side of East Main Street in the vicinity of the pump station to the approval of the Town Engineer.
7. A pre-construction conference must be scheduled by the permit holder prior to the commencement of any site work other than installation of the limits of disturbance (orange construction fencing) and temporary erosion and sediment controls. The Town must be given notice of at least 72 hours prior to the desired date of the conference.
8. Wetland mitigation planting plan must be developed in detail and approved by the Town Engineer prior to the commencement of work. No planting substitutes may be made without the prior written approval of the Town.
9. No work may commence on the site until a Town building permit is obtained.
10. An as-built map which details the location, size and species of the wetland plantings must be provided prior to the issuance of a certificate of occupancy.
11. Prior to the issuance of a building permit, a wetland bond in the amount of $1,500 shall be posted as a condition of this permit. The bond shall be released when it is verified by the Town that there has been no less than 85% survival of plant material shown on the as-built map as measured three years from the date of the Town’s receipt of the as-built map. The owner grants permission to the Town to periodically inspect the plant material to insure compliance throughout the time period.
12. Prior to the issuance of a building permit, a separate erosion and sediment control bond must be provided to the Town in the amount of $7,500. This bond will be released when the Engineering Department verified that the site is stable and the stormwater pollution plan has been completed as approved. Stable is defined as vegetative growth on 90% of exposed soil surfaces or coverage of entire exposed soil surfaces with erosion blankets approved by the Town Engineer.
13. Applicant agrees that as a condition of the issuance of the wetland permit the premises shall remain a single-family residence and be used as such. If the use shall change, the permit will lapse and the applicant/owner will have to come back to the Town Board for further review.

RESOLVED, that notice is hereby given that a public hearing will be convened by the Town Board, Town of Yorktown, Westchester County, New York at the Mohegan Colony Association, Oak Street, Mohegan Lake, New York on the 20th day of June, 2006 at 6:00 o’clock PM to consider the application of Mohegan Lake Improvement District for a Wetlands Permit to continue a 10 (ten) year lake management plan, including Aluminum Sulfate (alum) treatment to all open areas of Mohegan Lake. Treatment area is 104 acres with an estimated volume of 884 acre feet. Treatment is intended to remove phosphorus from the water column and will provide an alum blanket over the lake sediments to reduce sediment release of phosphorus.
A copy of said proposal is on file in the office of the Town Clerk, at the said Town Hall, where the same may be inspected during regular office hours.

WHEREAS, said map, plan and report, including an estimate of the cost, were prepared by a competent engineer duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any persons interested in the subject matter thereof, including estimate of cost; and
WHEREAS, the boundaries of said District shall be as described in Exhibit A attached hereto and hereby incorporated herein; and
WHEREAS, the improvements proposed for said District consist of the construction of a sanitary main of approximately 2,260 linear feet of 8-inch diameter sewer pipe, including original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith, all as more fully described in the map, plan and report hereinbefore described; and
WHEREAS, the maximum estimated cost of said improvements is $750,000; and
WHEREAS, the proposed method of financing the local share of the cost of said improvements consists of the issuance of $750,000 serial bonds of said Town maturing in annual installments over a period not exceeding forty years; and
WHEREAS, the estimated cost of hook-up fees to the typical property in said District is $2,000.00; and
WHEREAS, the estimated cost of said District to the typical property therein is approximately $1,498.94 in the first year in which operation, maintenance, debt service and other charges and expenses are to be paid; provided, however, that the annual cost will vary significantly from parcel to parcel depending upon assessed valuation and water consumption; and
WHEREAS, a detailed explanation of the manner by which said estimated costs of hook-up fees and first-year costs to the typical property were computed has been filed in the office of the Town Clerk where the same are available during regular office hours for examination by any person interested in the subject manner thereof; and
WHEREAS, it is now desired to call a public hearing upon the question of the establishment of said District and the improvements proposed therefor, all pursuant to Section 209-d of the Town Law; NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Yorktown, Westchester County, New York, as follows:
Section 1. A meeting of the Town Board of the Town of Yorktown, Westchester County, New York, shall be held at Mohegan Colony Lake, in Mohegan Lake, New York, in said Town, on the 20th day of June, 2006, at 6:00 o'clock P.M., Prevailing Time, for the purpose of holding a public hearing to consider the establishment of a sewer district in said Town as described in the preambles hereof, to be known as Suncrest Sewer District, and the improvements proposed therefor, and to consider the map, plan and report filed in relation thereto, and to hear all persons interested in the subject matter thereof concerning the same, and for such other action on the part of said Town Board as may be required by law or shall be proper in the premises.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this order to be published once in The North County News, the official newspaper of said Town, the first publication thereof to be not less than ten nor more than twenty days before the day set herein for the hearing as aforesaid, and said Town Clerk shall also cause a copy thereof to be posted on the sign-board of the Town maintained pursuant to subdivision 6 of Section 30 of the Town Law not less than ten nor more than twenty days before the day set for the hearing as aforesaid.
Section 3. This order shall take effect immediately.
