TOWN BOARD MEETING
        Deputy Supervisor James Martorano called the meeting to order. Deputy Town Clerk Diana L. Quast, Acting Town Engineer Sharon Robinson and Town Attorney Kevin Sweeny were also present.                                         
                                        
       
PRESENTATION
        Deputy Supervisor James Martorano introduced the Yorktown High School Girls Lacrosse Team who recently won the State Championship. He stated that the Yorktown High School Girls Lacrosse Team are champions, and in eleven years, they have won the State Championship four times. Mr. Martorano stated that the town is very lucky to have such talented young athletes.

        Athletic Director Theo Nardone stated that the Yorktown Girls Lacrosse team has won the State championship for the fourth time and thanked the Board for recognizing this tremendous feat.  

        Deputy Supervisor Martorano gave each member of the Yorktown Girls Lacrosse Team Certificates of Achievement from the Town Board for their fantastic accomplishments.
                                                                

DURING COURTESY OF THE FLOOR, the following people spoke:

        Ken Belfer welcomed everyone to Mohegan Colony Lake and gave a brief history of the property and its use.  The Board thanked Mr. Belfer for his comments.

        Lincoln Diamant and Monica Doherty spoke about a book that was prepared and edited by them called “The nasty Affair at Pines Bridge” Mr. Diamant stated that on May 14, 1781, the British and Loyalists initiated a guerilla raid on the all black 1st Rhode Island Regiment which had the responsibility to guard the Pines Bridge crossing of the Croton River. The group was headquartered at the Davenport House in the Croton Heights area of Yorktown and was under the command of Lt. Col. Greene. A monument to those almost 100 patriots who died or were captured in the battle is located at the First Presbyterian Church of Yorktown. Ms. Doherty explained that the book is based on Revolutionary War research done about 50 years ago by Allison Albee, a noted Westchester historian. The introduction is by Lincoln Diamant, a local author and historian.                                                                 
        Denis Horbatak stated he was glad the Board is here tonight to see what they are always trying to preserve. He asked that the Board consider keeping its open space rather than selling it.
                        
PUBLIC HEARING
MOHEGAN LAKE IMPROVEMENT DISTRICT - REQUEST FOR
WETLAND PERMIT - MOHEGAN COLONY LAKE
        Deputy Supervisor Martorano called to order a public hearing to consider the application of Mohegan Lake Improvement District for a Wetlands Permit to continue a 10 (ten) year lake management plan, including Aluminum Sulfate (alum) treatment to all open areas of Mohegan Lake.  Treatment area is 104 acres with an estimated volume of 884 acre feet.  Treatment is intended to remove phosphorus from the water column and will provide an alum blanket over the lake sediments to reduce sediment release of phosphorus.
                                        
        All those present having been given the opportunity to be heard and there being no further discussion the hearing was closed.   Councilman Nicholas Bianco motioned, seconded by Councilman Matthew Metz.
                

MOHEGAN LAKE IMPROVEMENT DISTRICT
WETLAND PERMIT - MOHEGAN COLONY LAKE
RESOLUTION #314 
        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        RESOLVED, that the Mohegan Lake Improvement District application for a wetlands permit made for the purposes of maintaining, preserving and enhancing the quality of the Mohegan Colony Lake and its surrounding wetlands is hereby approved.

PUBLIC HEARING
CREATION OF SUNCREST SEWER DISTRICT
        Deputy Supervisor James Martorano called to order a public hearing to consider the creation of the Suncrest Sewer District. A resolution making certain determinations in relation to and finding it to be in the public interest to establish a sewer district in the Town of Yorktown, Westchester County, New York, to be known as Suncrest Sewer District.

        All those present having been given the opportunity to be heard and there being no further discussion the hearing was closed. Councilman Nicholas Bianco motioned, seconded by Councilman Matthew Metz. 


CREATION OF SUNCREST SEWER DISTRICT
RESOLUTION #315 
The following resolution was offered by Councilman Nicholas Bianco, who moved its adoption, seconded by Councilman Louis Campisi, to-wit:
                                                                        
WHEREAS, the Town Board of the Town of Yorktown, Westchester County, New York, has received a petition for and duly caused to be prepared a map showing the boundaries of a proposed Sewer District in said Town, to be known as the Suncrest Sewer District, and a plan and report in connection therewith; and

WHEREAS, said map, plan and report were prepared by a competent engineer, duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said town, where the same is available during regular office hours for examination by any persons interested in the subject matter thereof; and

WHEREAS, the estimated cost of hook-up fees to the typical property in said District is $2,000 and
                
WHEREAS, the estimated cost of said District to the typical property therein is $1,498.94 in the first year in which operation, maintenance, debt service and other charges and expenses are to be paid and

WHEREAS, said capital project for said District and the establishment thereof has been determined to be an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, the Town Board has determined will not result in any significant environmental effects; and
                                                                        
WHEREAS, an order was duly adopted by said Town Board on May 16, 2006, reciting a description of the boundaries of said proposed Suncrest Sewer District, the improvements proposed, the maximum amount proposed to be expended for said improvements, the proposed method of financing to be employed, the fact that said petition, map, plan and report were on file in the Town Clerk's office for public inspection and specifying the 20th day of June, 2006, at 6:00 o'clock P.M., local time, at Mohegan Colony Lake, Oak Street in Mohegan Lake, New York, in said Town, as the time when and the place where said Town Board would meet for the purpose of holding a public hearing to consider the establishment of said Suncrest Sewer District and said map, plan and report filed in relation thereto and to hear all persons interested in the subject thereof concerning the same; and

WHEREAS, notice of the aforesaid public hearing was duly published and posted in the manner and within the time prescribed by Section 193 of the Town Law, and proof of publication and posting have been duly presented to said Town Board; and

WHEREAS, said public hearing was duly held at the time and place in said order as aforesaid, at which all persons desiring to be heard were duly heard; and

WHEREAS, said Town Board has duly considered said map, plan and report and the evidence given at said public hearing; NOW, THEREFORE, BE IT

RESOLVED, by the Town Board of the Town of Yorktown, Westchester County, New York, as follows:

Section l.      Upon the evidence given at the aforesaid public hearing, it is hereby found and determined as follows:

a)      The Petition has been signed and acknowledged or proved or authenticated               as required by law and is otherwise sufficient;
b)      All the property and property owners within said proposed Suncrest Sewer                District, as described in the preambles hereof, are benefited thereby;
c)      All the property and property owners benefited are included within the                       limits of said proposed Suncrest Sewer District; and
d)      The establishment of said proposed the Suncrest Sewer District is in the public interest.               

Section 2.      This resolution shall take effect immediately.  
The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

WHEREAS, said Town Board has adopted a resolution on June~20, 2006 making the findings and determinations required pursuant to Section 194(1) of the Town Law; NOW, THEREFORE, BE IT

RESOLVED, by the Town Board of the Town of Yorktown, Westchester County, New York, as follows:

Section 1.      The establishment of Suncrest Sewer District in the Town of Yorktown, Westchester County, New York, to be bounded and described as hereafter set forth, and the improvements proposed therefor consisting of the construction of a sanitary main of approximately 2,260 linear feet of 8-inch diameter sewer pipe, including, original furnishings, equipment, machinery, apparatus and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $750,000, is hereby approved.  The method of financing the cost of said improvements shall be by the issuance of serial bonds of said Town maturing in annual installments over a period not exceeding forty years, such bonds to be payable from assessments levied upon and collected from the annual levy on all the taxable real property in said District at the same time and in the same manner as ad valorem taxes in an amount sufficient to pay the principal of and interest on said bonds.
                                                                        
Section 2.      Said District shall be bounded and described as set forth in Exhibit~A.                                                                                 
        Section 3.      The Town Clerk shall, within ten (l0) days after this resolution takes effect, file certified copies of this resolution in duplicate in the office of the State Department of Audit and Control at Albany, New York, together with an application by this Board in duplicate for permission to establish such Suncrest Sewer District as provided for by subdivision 3 of Section 194 of the Town Law of the State of New York; and that such application shall be executed by and on behalf of the Town Board by the Supervisor of the Town.

Section 4.      This resolution takes effect immediately.
The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows:

NOTICE OF PUBLIC HEARING
MANA - WETLANDS PERMIT APPLICATION

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Railroad Station Park, Commerce Street, Yorktown Heights, New York on the 5th day of July, 2006 at 6:0 o’clock PM, or as soon thereafter as the same can be heard, to consider the application of Edward Mana fora wetland permit for property located at 2530 Gregory Street, Section 27.18, Parcel 2, Lot 44, Yorktown Heights.  Described work: Addition and alteration of an existing house including expanding existing driveway, relocated existing shed and pool and expand the existing pool deck.

        A copy of said proposal is on file in the Office of the Town Clerk, at the said Town Hall, where the same may be inspected during regular office hours.

        All persons in interest and citizens may be heard at the public hearing to be held as aforesaid.

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        WHEREAS, bids were accepted on Friday, June 16, 2006 for printing and delivering the 2006 Fall Program Brochure as specified to the Town of Yorktown Parks and Recreation Department, and

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Louis Campisi,

        WHEREAS, JP Morgan Chase (applicant) has made a request to replace existing signs on its building located at the Jefferson Valley Mall.

        RESOLVED, the application for a request to replace existing signs on its building located at  the Jefferson Valley Mall be referred to the Building Inspector, Planning Department, Town Board and ABACA.

APPOINTMENT - LIBRARIAN I
RESOLUTION #319
        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        BE IT RESOLVED, that Kathleen Scanlon is hereby appointed Librarian I from Eligible List No. 86-216 effective July 3, 2006 to be paid from Yorktown CSEA Salary Schedule A, Group XI, Step 1 working 25 hours per week to be paid $33,233 annually.

        BE IT FURTHER RESOLVED, that this appointment is subject to a probationary period of not less than 12 nor more than 52 weeks.

RETIREMENT
CLARENCE A. LANDER
YORKTOWN POLICE DEPARTMENT
        Supervisor Cooper announced the retirement of Clarence A. Lander from the Yorktown Police Department after 32 years of service.  Officer Lander’s last day will be June 29, 2006.

        WHEREAS, Robert Brannigan, as applicant, provided the Town with Western Surety Company Bond #70108377, in the amount of $5,000.00, to serve as the Erosion Control Bond for Town Board approving Excavation Permit #E-013-02, for work being performed on Delaware Road, NOW, THEREFORE BE IT

        RESOLVED, that Western Surety Company Bond #70108377, in the amount of $5,000.00, is hereby accepted to serve as the Erosion Control Bond for the above referenced Excavation Permit.

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        WHEREAS, Barbara Borok, as applicant, heretofore filed an Erosion Control Bond in the sum of $350.00, which was deposited into the T33 Account on November 15, 2005, covering Wetland Permit #077-05, for work performed at 378 Barway Drive,  and

        WHEREAS, the Town Engineer has informed this Board that a representative of her Department has inspected the property and determined that the work has been satisfactorily completed, and that the $350.00 for erosion control may be released, NOW THEREFORE BE IT

SERVICES AGREEMENT

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        RESOLVED, that the Town Supervisor is hereby authorized to sign a Stormwater Services Agreement with Stearns and Wheler in the amount of $151,000.00.

GRANT APPLICATION TO NYS DOT TRANSPORTATION
ENHANCEMENTS PROGRAM - RAILROAD STATION
RESOLUTION #326
        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        WHEREAS, the Town of Yorktown Town Board endorsed the placement of the Yorktown Railroad Station structure on the National Register of Historic Places (Section 10G, Lot); and

        WHEREAS, the Town Board of the Town of Yorktown committed monies for the services of a professional landscape architect or planner with Walter Sedovic Architects, Irvington, NY; and

        WHEREAS, the Town of Yorktown Town Board will commit a matching share up to 33%, including donations, supplies and/or materials, and volunteer labor as needed to meet the requirements of the grant;

        BE IT RESOLVED that the Town of Yorktown Town Board authorizes the Planning Department to apply to NYS Department of Transportation, Traffic Enhancements Program for the restoration of the Station at Railroad Park.

RELEASE OF ESCROW DEPOSIT - DRIVEWAY PERMIT
RESOLUTION #327
        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        RESOLVED, that the Town Board releases the escrow deposit in the amount of $500.00 for Driveway Permit #1138 to Judy Smith, 2886 Birch Street, Yorktown Heights, NY 10598.

AUTHORIZATION TO SIGN JOINT DEFENSE AGREEMENT
REGARDING CROTON LANDFILL
RESOLUTION #328                                         
        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        BE IT HEREBY RESOLVED that the Town shall enter into a Joint Defense Agreement with other municipal defendants named in the civil action styled Croton Point Landfill Joint Defense Group v. Kraft Food North America, et al., case number 06-CV-1693, which has been filed in the U.S. District Court for the Southern District of New York; and be it further

        RESOLVED that the Town shall contribute its share of the legal and administrative fees to be paid by members of the Municipal Defense Group according to the terms of the Joint Defense Agreement, beginning with an initial contribution of $2,500 with respect to the legal fees and an initial contribution of $50 with respect to administrative fees; and be it further

        RESOLVED that the Supervisor is authorized and directed to sign a Joint Defense Agreement, in form and substance satisfactory to the Town Attorney.

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Matthew Metz,

        WHEREAS, the Route 118 Turn Lane Capital Project was authorized in 2004, and

        WHEREAS, multiple necessary changes have increased the estimated expenditures, and

        WHEREAS, the Town has secured verbal authorization for state funding, now

        BE IT RESOLVED, the Route 118 Turn Lane Capital Project authorization shall now be increased to $350,000, with the anticipated state grant as the major source of funds.

AUTHORIZATION TO SIGN INTER-MUNICIPAL
AGREEMENT - CROTON-TO-HIGHLANDS BIOTIC CORRIDOR

        RESOLVED, that the Deputy Town Supervisor is hereby authorized to sign an inter-municipal agreement regarding the Croton-to-Highlands Biotic Corridor.

        Upon motion made by Councilman Nicholas Bianco, seconded by Councilman Louis Campisi,           
                
        WHEREAS, the Town of Yorktown Town Board is desirous of including five parcels of land into the existing Peekskill Sanitary Sewer District, NOW THEREFORE BE IT         

        RESOLVED, that the Town Board of the Town of Yorktown does hereby request that the County of Westchester incorporate the following lands  into the Peekskill Sanitary Sewer District:

DURING COURTESY OF THE FLOOR, the following people spoke:

        Mr. Ken Belfer thanked everyone for coming. He stated that their beach season starts this weekend and guest passes are sold and available. He feels that this is a wonderful community and that the lake has suffered from run off. Someday the lake will need dredging and other improvements and he would like to see that those improvements are made.
