The Town Board met with Department Heads at 6:00 P.M.
WORK SESSION
Supervisor Linda G. Cooper called the meeting to order.
AUTHORIZE THE SUPERVISOR
TO SIGN AGREEMENT WITH LABOR COUNSEL
RESOLUTION #364
Upon motion made by Councilman Bianco, seconded by Councilman Martorano,
RESOLVED, the Supervisor is authorized to sign an agreement with the firm of Bond, Schoeneck & King for professional services for a period from August 1, 2006 to July 31, 2009.
Cooper, Martorano, Bianco, Metz and Campisi voting aye.

RE-AFFIRM CHAIRS OF
CABLE COMMITTEE
RESOLUTION #365
Upon motion made by Councilman Bianco, seconded by Councilman Martorano,
IT IS HEREBY RESOLVED, that the Town Board affirms its right to determine the Chair of the Yorktown Cable Advisory Committee and re-affirms the appointment of Maria LaMonica-DeSimone and Bill Rubin as the Co-Chairs of the Yorktown Cable Advisory Committee.
Cooper, Martorano, Bianco, Metz and Campisi voting aye.

YORKTOWN FARMS
ROUTE 6 NEAR CURRY STREET
The Town Board was joined in this discussion by David Steinmetz, the attorney for VJ Construction, owners of the property and their development team which included Daniel Ciarcia.
Mr. Steinmetz stated that his client is still interested in providing a benefit (sewers) to 67 property owners. We are proposing having a sub division processed under the R-140 zoning classification. This site had a R-120 zoning for decades until the Board rezoned it in the Comprehensive Plan to R-180. The developer would need to construct 22 homes to offset the construction of the sewers. Mr. Steinmetz stated that the development team will be meeting with the State Department of Transportation in two weeks in an attempt to get access to the development from Route 6.
Councilman Campisi asked the developer if he was willing to fix the ballfield at Willow Pond rather than build the soccer field near his development?
Mr. Santucci stated that he was willing to do whatever he could.
Dan Ciarcia showed the Town Board several proposed layouts.
The Town Board will declare its intent to be lead agency at its August 1st meeting.
2005 AUDIT PRESENTATION
Joan Goldberg, the Town’s Comptroller and a representative with the Town’s auditing firm spoke about the results of the 2005 audit.
The Town is in excellent financial condition. The General Fund, fund balance for 2005 is $3,793,315. The Highway’s Fund Balance is $3,149.
SIX MONTH FINANCIAL UPDATE
Mrs. Goldberg reviewed the Town’s financial performance over the past six months with the Town Board.
HOG HILL PROPERTIES

Supervisor Cooper presented letters that she has received with regard to this project to the members of the Town Board.
Mr. Aldo Vitagliano, the attorney for the applicant updated the Town Board about their project. They have discussed the sewering of this development with the Towns of Ossining and New Castle.
Discussion concerning whether this application should continue. Several Board members suggested that the applicant speak to members of the Westchester County Legislature. If they are unable to reach any agreement on getting sewers, the project has no chance of getting approved.
Mr. John Kirkpatrick, attorney for homeowners in the Random Farms Development asked the Town Board to send the applicant away because a sewer line is going to be impossible to get.
The Board agreed that it would Declare lead Agency Status and issue a positive environmental declaration at its next meeting.
DEBRIS ON PRIVATE PROPERTY
Councilman Bianco’s proposed local law was discussed.
Residents from different areas in Yorktown expressed their concern that the current laws were ineffective. One gentleman stated that his neighbor has dead trees on his property and he has had an arborist determine that they are dead, but his neighbor refuses to do anything. Mrs. Maddox complained that her neighbor has all types of debris on his property which is making it difficult for her to sell her home.
Councilman Martorano read a section of Chapter 225 of the Code of Yorktown and determined that the code enforcement agent does have the power to resolve these problems.
The Town Board discussed a new law by the City of Mount Vernon which prohibits signs on public property as well as utility poles. Joseph Hughes, the Code Enforcement Officer stated that he’s constantly taking down signs.
Town Attorney Kevin Sweeny informed the Town Board that the Code of the Town of Yorktown also allows the police to enforce laws concerning signs.
Councilman Martorano will send a letter from the Town Board informing the Police Department that the Code of Yorktown also empowers them to remove signs from public property.
