TOWN BOARD MEETING
Supervisor Linda G. Cooper called the meeting to order.
MOMENT OF SILENCE
In honor of our Armed Forces serving in the military.
PRESENTATION
Supervisor Cooper introduced Neal Larson, a partner at Larson Fisher Associates, Historic Preservation and Planning Services. Mr. Larson provided the Town Board with an overview of the Reconnaissance Level Historic Resource Survey conducted in the Town of Yorktown. The one year study was prepared for the Landmarks Commission and paid for with a grant.
DURING HER REPORT TO THE TOWN, Supervisor Linda G. Cooper, announced that the Town of Yorktown had received another Distinguished Budget Award from the federal government. A public hearing will be held on September 29th regarding the Older American Act. A seminar will be conducted for anyone thinking about or involved in site excavation work on October 3rd. The first half of the school tax bill is due on or before Monday, October 2nd. Speaking on behalf of the Town Board, Supervisor Cooper extended her sympathy to the families of the teenagers who lost their lives over the weekend.
DURING THE TOWN COUNCIL’S REPORT TO THE TOWN, Councilman Bianco announced that Assemblywoman Sandra Galeff will hold a meeting on how we finance education in New York on Friday at the Cortlandt Town Hall. Also, tomorrow is the launch date for Turner Classic Movies on Cablevision in Yorktown.
DURING REPORTS FROM WESTCHESTER COUNTY, Legislator Michael Kaplowitz stated that they are looking for a senior from this 4th County Legislative District to participate on the Older American Act Task Force. Governor Pataki has signed legislation that will save Westchester Medical Center. New York State will be sending $65 million to the medical center. The Medical Center may also get an additional $31 million dollars from the federal government. Legislator Kaplowitz also spoke about the public meeting he will be chairing in which he and other members of the County Legislature will attempt to find out why the response time Con Ed and NYSEG during the recent storms is so long. He further stated that the utility companies must be held accountable for these outages. Perhaps some of
their stock dividends should be invested back into their infrastructure. Also, Con Edison promised to reimburse some of our down county residents who were without power for days for some cost. They have chosen to renege on that deal. Legislator Kaplowitz also stated that he is working hard on all of the resolutions that Yorktown sends him requesting placement into the Peekskill Sanitary Sewer District.
Supervisor Cooper stated that the Municipal Officials Association is also working with Con Edison. We are asking them to prioritize areas, giving preference to areas which are on wells and septic.
DURING COURTESY OF THE FLOOR, the following people addressed the Town Board:
Mrs. Grace Roma stated that while she did not blame the Yorktown Police because they were only following orders, she wanted to know why the Town Board would direct its police force to remove signs from private residences. She placed a sign for the Rotary Club’s Hole-In-One on her property the Friday evening before the event and on Saturday morning, the sign was gone. The Police Department told her that they had removed it because it was on town property. She wants to know if the Town has a deed to the bottom portion of her property?
Mr. Howard Frank spoke about the proposed local law concerning property maintenance. One of the things that he says the proposal doesn’t address is trees planted near power lines. He also stated that County Legislator Kaplowitz should also find out why or if Con Edison and NYSEG have co-mingled lines in the Town of Yorktown. Mr. Frank further stated that last year Con Edison told the Town Board that it would be upgrading their sub-station near the Jefferson Valley Mall, but he says nothing has happened.
Mr. Edward Donovan spoke of a federal law which allows local governments to enforce immigration laws. The federal government will also pick up the tab for training. Has Yorktown considered taking advantage of the training.
Supervisor Cooper asked Mr. Donovan if he would share this information with Police Chief McMahon.
Mr. Al DePrado, a resident of Yorktown since 1971 spoke about the importance of the local rotary club which was formed in 1949. Since that time, the club has provided monetary gifts to a host of community organizations including the DARE program run by the Police Department. Mr. DePrado further stated that the Hole In One is Rotary’s largest fund raiser and had been badly hurt by the lost of signs.
Police Chief McMahon stated that his department did remove the signs, they are in the garage of the Police Department and will be returned after November 15th.
PUBLIC HEARING
PROPOSED LOCAL LAW
AMENDING CHAPTER 216 RELATING TO NOISE
Supervisor Cooper open the public hearing to consider a proposed local law deleting Chapter 216, Section 216-2 of the Code of the Town of Yorktown and creating a new noise ordinance hereby known as Chapter 203. The Town Clerk presented affidavits of posting and publication.
Mr. Kevin Sweeny, Town Attorney for Yorktown explained the genesis of the law stating that the Town began working on this update to the law several years ago when New York City stated that it would be placing generators at its pump station near the Croton Reservoir. Since that time, the proposal has several changes starting with prohibiting noise about a certain decibel reading to using a reasonable person standard.
Supervisor Cooper read a response from the Planning Board which asks for clearer definitions, points out a conflict in two sections of the proposal and asks that time homeowners can legally use their lawn mowers be lengthened.
She read a letter from Nicholas and Virginia Crimarco who asked that special consideration be given to homeowners who use generators in emergency situations. Their son has special needs and if the power fails, their generator goes on to keep his medicine at the prescribed temperature.
The Supervisor also referred to a written communication that she received from Jane Mazzitelli requesting noise abatement rules.
A written communication from Mr. Mark Drexell also requests the Town Board to address generators.
A written communication from Mr. Bill Kimball, Director of the Division of Agricultural Protection and Development Services for the NYS Department of Agriculture and Markets takes issue with the proposal stating that it is evident that the exemption for noise generated by agriculturally or farm related equipment used in the production of agricultural crops was omitted from this draft. He also suggested that the Town Board include an exemption from noise created by animals on a farm operation.
Mr. Joseph Hughes, the Yorktown Code Enforcement Officer asked that motor vehicles be included in the proposal and that snow blowers be exempt.
Police Chief Daniel McMahon stated that the terminology both in the law currently on the books, and the proposal is vague. They have written summons for excessive noise complaints, but generally lose when we go to court. He explained that Police Officers responding to a noise complaint generally give a warning on their first visit. If they are called back to the scene, then they will hand out a summons. This year, the Police have responded to 131 noise complaints, but have only issued two summonses. Chief McMahon stated that what might be unreasonable to one officer, may be reasonable to another. The City of Yonkers and the Town of Kent both have noise ordinances that use decibel readings. He suggested that the Town come up with
a proposal that would combine both the reasonable person standard as well as a decibel reading standard.
Mr. Jeremiah Dineen read from written comments cover two pages (a copy is on file in the Town Clerk’s Office) stating that many of the terms in this proposal are so vague and subjective as to render a local law based on the “police power” of the state which includes provisions for fines, penalties and incarceration, to be rendered un-Constitutional and unenforceable. A prudent law should have objective, quantifiable standards to aide the police department in enforcement thereof, and to enable the prosecutor to effectively enforce the law in the Court system. He further stated that there should be an exemption for the operation of snow removal devices in inclement weather.
Mr. Dineen also read written comments from Mrs. Barbara Wilkens , owner of a farm in Yorktown as well as the Chair of the Westchester County Agriculture and Farmland Protection Board. Mrs. Wilkens writes that the current noise law exempts ordinary and usual farm activities. But, the new law does not. She says we hope this was an oversight.
Supervisor Cooper stated excluding the exemption of ordinary and usual farm activities was an oversight on the Town’s part.
Mr. Edward Donovan explained that in the 1950's when he was a police officer, the officer would stand a block away from the site of the complaint and listen and then issue a summons.
Mr. Howard Frank referred to the decibel meter that he brought in during the first public hearing on this proposal. He handed the Town Board a copy of a high efficiency air conditioning guide which lists their sound levels. He suggested that advertisements be made a part of this proposal.
Mrs. Grace Roma stated that this law is going too far, she stated that life is getting ridiculous.
Councilman Bianco stated that the majority of complaints he sees today involve quality of life issues.
Councilman Martorano stated that the Board must constantly do a balancing act with these types of complaints.
All those present having been given the opportunity to be heard and there being no further discussion the hearing was adjourned. Councilman Metz motioned, seconded by Councilman Bianco.
