Town Board Minutes 09/26/2006
Work Session meeting held by the Town Board,
Town of Yorktown on September 26, 2006 held at
Yorktown Town Hall, Yorktown Heights, NY
                                
                
Present:        Linda G. Cooper, Supervisor

                Matthew Metz, Councilman

EXECUTIVE SESSION       
        At 6:15 p.m., Councilman Bianco moved, seconded by Councilman Martorano, to move into Executive Session to discuss the employment of a particular person and perform interviews for volunteer boards. At 6:45 p.m., Councilman Campisi moved, seconded by Councilman Metz, to move out of Executive Session and proceed with the Work Session.  

        Councilman Martorano leaves the meeting due to a family emergency.

WORK SESSION
        Supervisor Linda G. Cooper called the meeting to order.  Town Attorney Kevin Sweeny was also present.           

BOCES TRAFFIC PATTERN
Yorktown Highway Superintendent Eric DiBartolo, three officials of BOCES including
the Superintendent Tom Higgins, Somers Supervisor Mary Beth Murphy along with residents of her Town and Police Officer Larry Eidelman participated in this discussion with the Town Board.

        Mr. DiBartolo stated that unless the traffic pattern for buses entering and leaving the BOCES campus change, he will have no choice other than to close a portion of Pinesbridge Road which was meant to be an emergency access road.  The buses which are bringing children from different parts of Westchester County has created a traffic nightmare in the Junior Lake area and traffic tie-ups in the middle of Town.

        Mr. Higgins explained that he would like to enter negotiations on how to resolve this problem.

       Mrs. Murphy explained that she would like to be a part of the negotiations.

        Supervisor Cooper asked Officer Eidelman to act as a facilitator in the discussion which will begin to take place tonight.

        
TOWN CODE ENFORCEMENT
        Police Chief Daniel McMahon and Code Enforcement Officer Joseph Hughes were present to discuss Town Code enforcement procedures with the Board.
        
                        
TRAFFIC TICKET ENFORCEMENT
        Town Attorney Kevin Sweeny gave an overview to how the change in state law came to be.  New York State Troopers will no longer act as the prosecutor on cases involving tickets they write in the Town of Yorktown.  Mr. Sweeny stated that according to law, the Westchester District Attorney’s Office is responsible for prosecuting all offenses.  He suggested that the Town of Yorktown in conjunction with the Westchester Municipal Officials pressure the District Attorney’s Office to prosecute these cases.

        Councilman Metz stated that there is no way the Westchester District Attorney’s Office is going to prosecute simple traffic offenses.  He suggested that the Town considering hiring someone and have them work on it.

        Supervisor Cooper stated that she had no problem bringing Kevin’s suggestion to the Municipal Officials Association, but she said some Towns such as Bedford have already worked out agreements with local lawyers to prosecute these cases.

        This discussion will continue at a later date.


GLOBAL SIGNAL
        A representative from High Pointe Consulting and Water Superintendent Jeff Wynans his Assistant Bradley Lewis, participated in this discussion of a new cell tower lease.

        Jeff Wynans gave his support to the Town Board approving this new lease.
                

WATER SUPPLY CONNECTIONS
PINESBRIDGE DISTRICT/KITCHAWAN
        Water Superintendent Jeff Wynans was present to discuss with the Board a change in rate for the residents in the Yorktown District who get their water from the Town of New Castle.

        Residents served by the Pinesbridge District pay what users Consolidated Water District pay.  But, their water comes via the Town of New Castle whose rates are much higher than what New York City charges the Joint Water Works.  This new legislation would remedy this situation.  Pinesbridge Water District users would be paying the cost of water from the Town of New Castle.

        A public hearing will be held during the second meeting in October.


WETLAND ORDINANCE CHANGES
& ESCROW POLICY CREATION
        Town Attorney Kevin Sweeny and Bruce Barber, the Environment Enforcement Officer participated in this discussion.

        The Town Board was assured that this proposal will eliminate some of the bureaucracy involved in getting a wetlands permit and pay for a wetlands inspector who will only visit the property if needed.
                                                                                        
        Public hearings will be advertised for the second meeting in October.


REQUEST TO MODIFY SEWER DISTRICT
        Acting Town Engineer Sharon Robinson spoke about the letter she received from Bill Stahoviak to have The Town Board request a sewer district modification for his property so that it could become a part of the Gomer Street area district and the Westchester County Peekskill District.

        The Town Board asked Mrs. Robinson to notify the property owner that they would approve this request
                        

BLASLAND, BOUCK & LEE
RESOLUTION #427
        Upon motion made by Councilman Bianco, seconded by Councilman Campisi,
        
        WHEREAS, prior costs of $1,659.59 were incurred from Blasland, Bouck & Lee, NOW THEREFORE BE IT

        RESOLVED, that the Supervisor be authorized to approve payment of these costs.

        Cooper, Bianco, Campisi, Metz - Voting Aye
        Resolution adopted.
                                

TOWN BOARD MEETING AGENDA
        The Board discussed the October 3, 2006 Town Board meeting agenda.
        

ADJOURN
        Upon motion by Councilman Campisi, seconded by Councilman Metz and carried, the meeting was adjourned.
