Town Board Minutes 10/10/2006
Work Session meeting held by the Town Board,
Town of Yorktown on October 10, 2006 held at

                Matthew Metz, Councilman

EXECUTIVE SESSION
        Councilman Bianco moved, seconded by Councilman Campisi to move into Executive Session to discuss the employment of particular persons.

        Councilman Bianco moved, seconded by Councilman Campisi to move out of Executive Session and proceed with the Work Session.  
 

WORK SESSION
        Supervisor Linda G. Cooper called the meeting to order. Deputy Town Clerk Diana L. Quast and Town Attorney Kevin Sweeny were also present.
                                                                

REQUEST TO REZONE                               
MULTI-FAMILY ON ROUTE 202
RICK DECOLA
        Rick DeCola was present to discuss with the Board a request to put rental apartments on the ten acres behind the storage facility on Lexington Avenue and Route 202. The Board decided to decline consideration at this time.


JEFFERSON VALLEY SERVICE STATION
        Jay Hansman was present to discuss with the Board legalizing an existing sign. Mr. Hansman stated that signs were replaced at the Jefferson Valley Gas Station a few years ago and no permit was obtained because of that the signs are bigger then the law allows. He suggested removing part of the sign to make it smaller which will bring the sign down to a legal size. The Board agreed.
                

COMPREHENSIVE PLAN REZONES - PART II
        Director of Planning John Tegeder was present to discus with the Board the Comprehensive Plan Rezoning issues following the Public Hearing input. The Board discussed all of the issues that were brought forward and are taking them under consideration.


GRAFFITI LEGISLATION
        Town Attorney Kevin Sweeny was present to discuss with the Board draft legislation with regards to Graffiti. Councilman Martorano would like to see how other communities handle the issue of graffiti. He also feels that this is covered under the Penal law and local legislation is not needed.
                        
PROPERTY MAINTENANCE LEGISLATION
        Town Prosecutor Doug Fitzmorris was present to discuss with the Board revised draft legislation with regards to property maintenance.  The Board decided to further discuss this at a later work session.  

        
ENFORCEMENT OF STATE POLICE TICKETS
        Town Attorney Kevin Sweeny was present to discuss with the Board and review proposed disposition of tickets. Mr. Sweeny recommended having an outside person take over this process. The Board decided to discuss this issue further at a later work session.
        

GRANT FOR TREE PLANTING
FOR NYS DEP
RESOLUTION #443
        Upon motion made by Councilman Louis Campisi, seconded by Councilman Matthew Metz,
        
        WHEREAS,  the Town of Yorktown Town Board authorizes the Planning Department to
apply to NYS Department of Environmental Conservation Tree Planting Projects ; and

        WHEREAS the Town of Yorktown Town Board will commit a matching share including donations, supplies and/or materials, and volunteer labor as needed to meet the requirements of the grant;  be it

        RESOLVED that the Town of Yorktown Town Board authorizes the Planning Department
to apply to NYS Parks and Recreation and Historical Preservation for the 2006Urban Forest  Tree Planting Projects.

        Resolution adopted.
                

GRANT TO NYS PARKS RECREATION & HISTORICAL
PRESERVATION FOR RECREATIONAL TRAIL
RESOLUTION #444 
        Upon motion made by Councilman Louis Campisi, seconded by Councilman Matthew Metz,

        WHEREAS,  the Town of Yorktown Town Board authorizes the Planning Department to
apply to NYS Parks and Recreation and Historical Preservation for Parks 2007 Recreational Trails Program; and

        WHEREAS the Town of Yorktown Town Board will commit a matching share including donations, supplies and/or materials, and volunteer labor as needed to meet the requirements of the grant;  be it

        RESOLVED that the Town of Yorktown Town Board authorizes the Planning Department to apply to NYS Parks and Recreation and Historical Preservation for the 2007 Recreational Trails Program.

        Resolution adopted.
                

GRANT FOR TEATOWN LAKE RESERVATION
NYS OFFICE OF PARKS, RECREATION AND HISTORIC PRESERVATION
RESOLUTION #445
        Upon motion made by Councilman Louis Campisi, seconded by Councilman Matthew Metz,

        WHEREAS, Teatown Lake Reservation is applying to the New York State Office of Parks, Recreation and Historic Preservation for a grant under the Recreational Trails Program for a trail project to traverse the properties of Westchester County Kitchawan Preserve, NYS Stayback Hill, Croton Dam Road, NYC DEP watershed land, Westchester County’s John Hand Park and Westchester County’s Briarcliff Peekskill Trailway, sites located within the territorial jurisdiction of the Town of Yorktown.

        WHEREAS, as a requirement under the rules of these programs, said not-for-profit corporation must obtain the “approval/endorsement of the governing body of the municipality in which the project will be located”,

        NOW, THEREFORE, be it resolved that the Town Board of Yorktown hereby does approve and endorse the application of Teatown Lake Reservation for a grant under the Recreation Trails Program for a trail project know as Hudson Hills & Highlands Trailway and located within the community.

EXTEND BID BODYWORK TOWN CARS
RESOLUTION # 446
        Upon motion made by Councilman Louis Campisi, seconded by Councilman Matthew Metz,
        BE IT RESOLVED, that the Town Board of the Town of Yorktown hereby rescinds its Resolution dated October 3, 2006, to solicit bids for bodywork on Town Cars and,

        BE IT FURTHER RESOLVED, that effective immediately the Town Board authorizes the Town Clerk to notify all bidders of such revocation and,

        BE IT FURTHER RESOLVED, that the bid for Body Work on Town Cars which had been awarded to Tompkins Garage, 1440 Croton Lake Road, Yorktown Heights, NY be extended per the terms of the BID for one additional year: November 2, 2006 to November 1, 2007.

        Resolution adopted.

        Upon motion made by Councilman Louis Campisi, seconded by Councilman Matthew Metz,

        BE IT RESOLVED, that the Town Board of the Town of Yorktown hereby rescinds its Resolution dated October 3, 2006, to solicit bids for Bodywork on Town Trucks and,

        BE IT FURTHER RESOLVED, that effective immediately the Town Board authorizes the Town Clerk to notify all bidders of such revocation and,

        BE IT FURTHER RESOLVED, that the bid for Body Work on Trucks which had been awarded to Tompkins Garage, 1440 Croton Lake Road, Yorktown Heights, NY be extended per the terms of the BID for one additional year: November 2, 2006 to November 1, 2007.
