EXECUTIVE SESSION
Councilman Bianco moved, seconded by Councilman Campisi to move into Executive Session to discuss the employment of particular persons.
Councilman Bianco moved, seconded by Councilman Campisi to move out of Executive Session and proceed with the Work Session.
ARCADY ROAD IMA
Town Attorney Kevin Sweeny and Mr. John Potter from New York City’s Department of Environmental Protection joined the Town Board for this discussion.
The issue is the partial restoration of Arcady Road. Supervisor Cooper stated that the New York City Department of Environmental Protection will pay for the materials used to repair the highway. The Town of Yorktown will supply the manpower. Highway Superintendent DiBartolo sent a memorandum to the Board stating that he estimates the work would cost taxpayers at least $100,000. The Board was given a copy of a 1905 Agreement between the Town of Yorktown and the City of New York regarding roadways created by the construction of the New Croton Reservoir. Councilman Metz asked that the Town Attorney be given an opportunity to examine the document which may outline what the Town’s responsibilities are in relating to roads in
this area.
HUNTERBROOK RIDGE/GLASSBURY COURT WATER DISTRIST
Mr. Bill Balter, along with representatives of the Glassbury Court development, John Ahern, the Chief Executive Officer of the Field Home and Mr. Albert Capellini, the Attorney for the Field Home participated in this discussion with the Town Board. The issue on the table is whether Glassbury Court should pay an out of district tapping fee for water.
Mr. Capellini, the Attorney for the Field Home, the original owner of the property stated that this project is a part of the same project that was planned, designed and presented as a unified proposal by the Field Home. He further stated that it was also approved as one project. There was no discussion concerning the fact that one portion of the property is in the Consolidated Water District, and the other portion is outside of the water district. Mr. Capellini further argued that when the present owners purchased the property, the former Water Superintendent required them to build a loop system connecting Field Street’s water line with Catherine Street’s water line, something that was not in the original approved project.
This added an unbudgeted cost of more than $235,000. to the project.
Supervisor Cooper stated that the owners of Glassbury Court have agreed to a compromise, paying a portion of the out-of-district charge or, she said they can simply just wait. New York City is requiring the Town to place all of the out of district users into the Consolidated Water District.
There was discussion. The Town Board agreed to hold a public hearing in January placing Glassbury Court into the Consolidated Water District
JEFFERSON VALLEY MALL
Mr. Peter Lembo, General Manager of the Jefferson Valley Mall, Scott Blyze a representative of Melvin Simon Corporation and their Traffic Engineer joined the Board for this discussion.
The traffic engineer explained that Melvin Simon Corporation has asked the Department of Transportation for permission to purchase property along Route 6 to build a new turnoff into the Mall. This turnoff would eliminate backups on Route 6 into the Mall. This would only serve traffic entering the Mall.
Supervisor Cooper stated that there would be a need for landscaping if this happens.
Mr. Lembo agreed that the Mall would landscape that entrance.
The Board gave Supervisor Cooper permission to send a letter to the Department of Transportation supporting this plan.
TACONIC FUEL
The owner of the gasoline station along with a representative of Sign Inc.
Right now they have a temporary permit for a new sign but, are asking for permission to add another sign for their repair station. They also would like to get a canopy.
The Town Clerk will give them information on their request for a canopy which entails them applying to amend their special use permit.
AMEND LEGISLATION REGARDING GARBAGE COLLECTION
The Town Clerk explained that the fee for commercial carters has remained unchanged since 1990, also, while the Town’s residential carters hours are stated in their contract, there are no hours stated in the law covering commercial carters.
The Board agreed to hold a public hearing on this proposal on December 19th.
MISCELLANEOUS
The Town Board agreed to hold a public hearing on December 19th for a proposed local law adding a stop sign on Wildwood Street, to reconvene its hearing on a proposed local law amending the property maintenance statute.
EXECUTIVE SESSION
Councilman Bianco moved, seconded by Councilman Martorano, to move into Executive Session to conduct interviews for the Town Justice position being vacated by Judge Cohen as a result of his election to County Court Judge. Councilman Campisi moved, seconded by Councilman Metz, to move out of Executive Session

Upon motion by Councilman Campisi, seconded by Councilman Metz and carried, the meeting was adjourned.
