Supervisor Linda G. Cooper called the meeting to order. Town Attorney Kevin Sweeny and Town Comptroller Joan Goldberg were also present.

Supervisor Cooper read the following Proclamation:
WHEREAS Assemblyman Willis Stephens has served for 12 years in The New York State Legislature, representing the Town of Yorktown for four of those years;
WHEREAS Assemblyman Stephens has carried on a long family tradition of service to New York State residents following in the footsteps of his father and grandfather as the region’s representative in the State Assembly;
WHEREAS the Assemblyman’s talent and dedication to his constituents and colleagues was recognized through his appointment as Assemblyman Pro Tempore, the highest ranking position in the minority;
WHEREAS as a public servant Will Stephens spent countless hours and miles to represent the interests and concerns of residents in the Hudson Valley marking among his successes legislation improving clean air quality, transportation infrastructure, creating legislative open space funding mechanisms, and recodifyng criminal law statutes;
WHEREAS the Assemblyman has taken a lead in working to reduce fraud related to Medicaid and Workers Compensation Programs and even tackled the thorny issue of school finance reform during this past term in office;
WHEREAS the People of Yorktown are forever grateful for the efforts of this fine gentleman who has sacrificed his own personal life and privacy for the public good;
THEREFORE BE IT RESOLVED that I, Linda G. Cooper, Supervisor of the Town of Yorktown, along with the Members of the Yorktown Town Board, extend our gratitude and appreciation for all the good works performed by Assemblyman Stephens and we wish him best of luck in his new adventures; and furthermore we proclaim to all far and near that today is Will Stephens Day in the Town of Yorktown and ask all to join us in congratulating the Assemblyman for his service.
New York Assemblyman Willis Stephens accepted the Proclamation stating that it has been a great pleasure and honor to serve in the State Assembly for twelve years.
Councilman Martorano asked Mr. Stephens what his most memorable moment was?
Mr. Stephens said his most memorable moment was the very first time he was sworn into office. This is a position which was previously held by both his grandfather and his father.
DURING HER REPORT TO THE TOWN, Supervisor Linda Cooper yielded her time to Walt Daniels, Ed Killeen, Paul Moskowitz and John Schroeder, members of the Open Space Committee.
Speaking for the Committee, Mr. Daniels thanked Assemblyman Stephens for his work in getting the Town of Yorktown special legislation to collect the $30.00 fee for Open Space. The Committee is continuing its work locating parcels of property which are suitable to purchase for open space. Mr. Daniels applauded the Town Board for their recent resolution approving the purchase of the 33 acre parcel on Gomer Street formerly known as Solomon Farms.
Mr. Killeen also congratulated the Town Board for its decision to buy this property which he says sits within one of the most densely populated areas of Yorktown. Purchasing this property gives the Town opportunities to provide the residents with trails, parks, etc.

Mr. Arthur Ornek, speaking as a member of the Fire Prevention Commission asked that the Town Board reconsider its decision not to include a full-time fire inspector in the 2007 budget. He stated that while the two part-time inspectors are wonderful, the Town of Yorktown has grown and the regulations have become more complex. He further stated that during the last meeting Councilman Metz asked if there had been any problems as a result of only having part time inspectors; the answer is no, but what the Commission wants to do is prevent future fires. The best way to step into this issue is by placing a half year salary in the budget for 2007.
Supervisor Cooper stated that in addition to that request, the Town Board also heard from Mrs. Clemenza who had a problem with the overtime budget for the Library, another resident had a problem with the Library budget in general, they felt it was too high. The Supervisor further stated that if the fire inspector is placed in the budget, the current proposed increase will go from 3.99% to 4.2 or 4.5%
Councilman Campisi stated that placing a $50,000 item back in the budget is not as simple as it sounds. While the salary may be $50,000 for 2007, we are looking at a yearly salary of more than $100,000 for next year. We also took advice from UTY, using much more of our surplus funds than normal. We took $600,000 from the surplus to keep the budget at 3.99%. Addressing Mr. Ornek, Councilman Campisi stated that Mr. Metz asked if there was a problem with the part-time fire inspectors. He was told there was no problem.
Supervisor Cooper stated that the part-time inspectors do a fine job, but they are not getting to all of our buildings on a regular basis. She further stated that there are conditions which could be cited by the fire inspector, but are not. The job a full-time fire inspector will do is different from the job performed by the part-time inspectors.
Councilman Martorano stated that he would like to see the Town fund a drug unit, or at least one officer dedicated to fighting drugs. He also felt a full-time fire inspector was needed.
Councilman Metz stated that he didn’t want people to think that the Town Board does not take safety seriously. But, we asked if there was anything the current fire marshals were doing that was wrong. We were told no. No one ever said there were buildings that were not being inspected on a regular basis. He suggested that we treat this issue as a private business would. We will no longer continue to create new jobs. We will look outside the box to find solutions such as going into joint ventures with fire districts and using existing personnel to perform these tasks until we arrive at an acceptable solution.

WHEREAS, Supervisor Linda G. Cooper, acting as Budget Officer, did on the 31st day of October, 2006 filed her tentative budget with the Town Clerk and the Town Board for its review, and
WHEREAS, upon completion of its review and modification of the tentative budget, the Town Board filed its preliminary budget of the estimated revenues and expenditures for the fiscal year commencing January 1, 2007, and
WHEREAS, a public hearing was called and duly held on the 6th day of December, 2006, at the Town Hall, 363 Underhill Avenue, Yorktown Heights, NY at which time and place the Yorktown Town Board did meet and review such preliminary budget as compiled, and accepted public comment for or against any item contained therein, be it
RESOLVED, that the Town Board of the Town of Yorktown does hereby adopt such preliminary budget and be it
FURTHER RESOLVED, that the said preliminary budget as adopted by this resolution be entered in detail in the minutes of the proceedings of this Town Board and it shall be known as the Annual Budget of the Town of Yorktown for the fiscal year beginning on the 1st day of January, 2007, and be it

Councilman Bianco thanked the Supervisor for her work on this budget. He read a prepared statement, a copy of which is on file in the Town Clerk’s Office. He thanked Joan Goldberg, the Town Comptroller and her staff for their good work. The statement also expressed his desire to keep taxes at or below the inflation level, while maintaining services at the level that the people who live and work in the Town of Yorktown require. Councilman Bianco also said he would like to see this budget document which totals more than one hundred pages compressed into a twenty page summary form which can be placed on the internet.
Councilman Campisi thanked Supervisor Cooper and the Finance Department for their work on the budget . He repeated portions of his prior discussion concerning the $600,000 surplus which was placed in the budget. Councilman Campisi stated that the total tax increase amounts to $61.00 per year, or 16 ? cents a day.
Councilman Martorano started his conversation by talking about budgets for the Lakeland School District which he says totals $125 million and the Yorktown School District which totals nearly $80 million. The Town of Yorktown’s budget is much smaller, $48 million. Approximately 83.4% of our budget is for salary, contractual obligations and equipment.
Supervisor Cooper thanked the Finance Department for their work on the budget. She said taxes in New York are a major concern, and that perhaps people like the incoming Governor will work on finding solutions to our tax problem.
RECONVENE PROPOSED LOCAL LAW
AMENDING CHAPTER 300 - ACCESSORY APARTMENT CHANGES
Supervisor Cooper reconvene a public hearing to consider a proposed Local Law amending Section §300-38 “Accessory dwelling units in single family homes,” of Chapter 300 of the Code of the Town of Yorktown, by amending certain conditions under which accessory dwelling units can exist in a single family dwelling. The Town Clerk presented affidavits of printing and publication.
Mr. Ken Belfer explained that the proposed changes to the accessory apartment law were brought about as a result of discussions concerning the Comprehensive Plan. We learned that there were significant numbers of people who for one reason or another could no longer or might not be able to afford to continue to live in their home, but wanted to remain in Yorktown. We also learned that accessory apartments are located throughout the Town. After the public hearing on proposed amendments in March, the Community Housing Board attempted to put together a meeting of diverse groups such as the school boards and zoning boards. As a result of those meetings, we have come put with these proposed changes. If a lot has a special permit for an accessory
dwelling, they will not be given a special permit to store, park or stand any commercial vehicle or trailer. He also stated that the property owner would have to live in the larger unit. The proposal also drops the waiting period to apply for a special permit for an accessory apartment from five years to two years. The Housing Board also supports the proposal which permits the Zoning Board to waive the waiting period to allow the creation of an accessory apartment for a disabled person or a senior citizen 62 years or older. Mr. Belfer stated that his Committee also supports granting a waiver for deed restricted affordable housing. Right now, the only property that would be eligible for such a waiver is the housing that will be built on property owned by the Church of the Nazarine.
Mrs. Toni Downes-King, a member of the Housing Board spoke in favor of the proposed changes as well for the proposal suggested by Mr. Belfer giving affordable, or deed restricted housing the same waiver.
Mr. Mel Tanzamann, Executive Director of Westchester Disabled on the Move spoke in favor of the proposal, and to Mr. Belfer’s proposal to extending the waiver to deed restricted housing. He also spoke in favor of the Town Board permitting the owner of a home to live in the smaller unit, instead of the larger unit.
Supervisor Cooper read a letter from Mr. Michael Saltzman, a copy is on file in the Town Clerk’s Office regarding the proposal. Mr. Saltzman stated that this proposal could have an effect on zoning and therefore required an Environmental Impact Statement.
Mr. Anthony Grasso who works on the Finance Committee for the Yorktown School District stated that he was against any proposal that would permit the owner to rent out the larger unit.
Mr. Belfer returned stating that the Town of North Castle permits waivers on its deed restricted housing. He spoke to an administrator of the program who told him there had not been any type of negative impact on the school district with this measure.
Supervisor Cooper stated that she supported adding deed restricted housing to the list of exemptions.
Councilman Martorano agreed stating that we discussed allowing this type of housing on property owned by the Church of the Nazarine during a work session.

CONVENE PUBLIC HEARING
AMENDING CHAPTER 225 - PROPERTY MAINTENANCE
RESPONSIBILITIES OF PROPERTY OWNERS
Supervisor Cooper called to order a public hearing to consider a proposed Local Law amending Chapter 225 of the Code of the Town of Yorktown with regards to property maintenance responsibilities of property owners. The Town Clerk presented affidavits of printing and publication.
Councilman Bianco asked Mr. Joseph Hughes, Yorktown’s Code Enforcement Officer to explain the changes. He explained that most of these changes were brought about because of the his inability to cite property owners for failure to maintain their property primarily due to the lack of clear definitions.
Mr. Alex Swerdlov, a resident of Yorktown stated that he has been trying to get his neighbor to remove dead trees which he says threatens his property with no success. He believes this law needs to include a timetable.
Mrs. Kathleen McCormick stated that she supports this proposal. Property near her home represents an eyesore to the community.
Mr. Scott Markman, a resident of Cordial Road sated that there is a situation in his neighborhood which is not only an eyesore, but he believes is also an environmental hazard because his neighbor treats the property like a garbage dump. He also asked if the proposal contains a provision which requires the owner to pay for the cost of cleaning the property if town workers are used?
Councilman Metz asked Mr. Hughes if he was satisfied that this proposal would give him the enforcement capabilities he needed?
Mr. Hughes was satisfied with the proposal. He added that there is a ten day timetable in summons he hands out.
Supervisor Cooper asked the Town Attorney if there was any liability to the Town if town workers are brought in as a result of an owners failure to clean his property?
Mr. Sweeny stated that there was always the potential for liability but that the Town would
only resort to this type of action after giving the property owner due notice.
Mr. Jeremiah Dineen complained that the current proposal is better than the one that the Board began this process with. But, he says the problem continues to be the fact that this law does not contain any standards. Mr. Dineen stated that according to this proposal, his compost site could be considered a problem. One of the reasons for standards, according to Mr. Dineen is that some problems are worse than others and may require a shorter time table. He also stated that no exemption for agricultural has been added to this law.
Councilman Martorano stated that he agreed with Mr. Dineen concerning the first draft of this law which dealt with mostly maintenance issues. But, what we are attempting to shine a spotlight on extreme examples, those which could possibly be health hazards. We are not looking at issues such as someone’s compost
Councilman Metz stated that the Board did agree to exempt agricultural districts from this law, this was an oversight which we will correct right now.

AMENDING CHAPTER 275 - ADDING A FULL STOP
WILDWOOD STREET AND SUNCREST AVENUE
Supervisor Cooper called to order a public hearing to consider a proposed Local Law amending Chapter 275 of the Code of the Town of Yorktown, by adding a full stop at the intersection of Wildwood Street and Suncrest Avenue in each direction. The Town Clerk presented affidavits of printing and publication.
Councilman Metz explained that this proposal is a result of residents living in this area coming before the Traffic Advisory Board asking for something to be done. Members of the Board made a site visit and agreed that a stop sign needed to be added in this area because of sight distance issues.
Councilman Campisi stated that he normally disagrees with adding a stop sign to a T intersection. But, he says there are real site distance problems here.

Upon motion Councilman Bianco, seconded by Councilman Martorano,
NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of January, 2006 at 7:30 o'clock PM, or as soon thereafter as the same can be heard, pursuant to Chapter 135 of the Code of the Town of Yorktown. An inspection by two Assistant Building Inspectors observed that the roof sheathing and roof rafters were severely rotten and parts of the roof were missing, as well as the walls of the structure were severely rotten and posed the possibility of collapse. The premises of Louis and Gloria Rosenberg located at 1704 Decatur Road A/K/A Section 0305, Parcel 220 and Lot 11 on the Tax Map of the Town of
Yorktown.
A copy of the documentation concerning the above is on file in the office of the Town Clerk where the same can be inspected during regular office hours.

Upon motion Councilman Bianco, seconded by Councilman Martorano,
NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of January, 2007 at 7:30 o'clock PM, or as soon thereafter the same can be heard, to consider the application of VS Construction Corp., the developers of Yorktown Farms Subdivision, pertaining to their request for amending the Town of Yorktown Zoning Ordinance and Zoning Map, and, for related land use as it pertains to lands located along Route 6 and at the end of Gay Ridge Road in the Town of Yorktown, State of New York, known and designated on the Town Tax Map as Section 6.17, Parcel 3 totaling approximately 43 acres.
The petition is for Rezoning of the subject property from the R1-80 Zoning District into the R1-40 District. The plans illustrate a proposed twenty-two (22) lot subdivision.

NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 6th day of February, 2007 at 7:30 o'clock PM, or as soon thereafter as the same can be heard for the purpose of amending Chapter 260, Section 260-1(A) and Section 260-2(A) of the Code of the Town of Yorktown granting a partial tax exemption on real property owned by persons 65 years of age or over who meet the statutory qualifications of Section 467 of the Real Property Tax Law. The purpose of the amendment is to increase the maximum income ceiling to $37,400 and make eligible any person qualified under Section 467 of the Real Property Tax Law.

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 6th day of February, 2007 at 7:30 o'clock PM, or as soon thereafter as the same can be heard for the purpose of amending Chapter 260, Sections 260-25(A) and 260-29(A) of the Code of the Town of Yorktown granting a partial tax exemption on real property owned by persons with disabilities and limited incomes of Section 459-c of the Real Property Tax Law. The purpose of the amendment is to increase the maximum income ceiling to $32,400 and make eligible any person otherwise qualified under this section who is with disabilities and meets this criteria for Section 459-c
of the Real Property Tax Law.
All persons in interest and citizens may be heard at the public hearing to be held as aforesaid.

NOTICE IS HEREBY GIVEN that sealed proposals will be received by the Town
Clerk of the Town of Yorktown, Westchester County, NY until 11:00 AM on Tuesday,
January 2, 2007 at the Town Hall, 363 Underhill Avenue, Yorktown Heights, NY 10598
For contracting bus service for various programs (Section I: School Buses - Potential
Senior Trips Section II Coaches - Senior Citizen Trips; Section III: Potential Senior
Citizen Trips using Coaches. This is an eleven (11) month contract starting February 1,
2007 and ending on December 31, 2007.
All bids must be accompanied by an executed non-collusion bidding certificate.
Specifications may be obtained at the office of the Town Clerk at said Town Hall,
Yorktown Heights, NY during regular office hours.
The bidder assumes the risk of any delay in the mail or in the handling of mail by
the employees of the Town of Yorktown. Whether sent by mail or means of personal
delivery, the bidder assumes the responsibility for having bids in at the time and the
place specified above.
The Town Board reserves the right to reject any or all bids and to accept that bid
which it deems most favorable to the interests of the Town of Yorktown.

WHEREAS, invitation to bid for a 2007 L7500 Sterling, was duly advertised, and
WHEREAS, said bid was received and opened on the 19th day of December, 2006, with the bid amount, as follows:

Upon motion Councilman Bianco, seconded by Councilman Martorano,
BE IT RESOLVED, that the Town Board approves the memorandum of Agreement between the Town of Yorktown and the Yorktown Superior Officers Benevolent Association dated December 19, 2006 covering the period from January 1, 2006 through December 31, 2006.
BE IT FURTHER RESOLVED, that the Town Supervisor is authorized to execute a collective bargaining agreement for the period from January 1, 2006 through December 31, 2006 that is consistent with the terms of the Memorandum of Agreement.

RESOLUTION REGARDING POLICE
PERSONNEL MATTER
RESOLUTION #531
Upon motion Councilman Bianco, seconded by Councilman Martorano,
WHEREAS, on December 13, 2006, the Chief of Police preferred disciplinary charges against a member of the Yorktown Police Department (Employee Payroll #1917); and
WHEREAS, the Chief of Police forwarded said charges to the Town Board for a hearing pursuant to the Westchester Police Act of 1936 (Chapter 104 of the Laws of 1936); and
WHEREAS, the Board believes it is in the best interests of the Town that the police officer involved be suspended without pay pending a hearing and determination on the charges;
NOW THEREFORE, BE IT RESOLVED that pursuant to the Westchester Police Act of 1936, the police officer (Employee Payroll #1917) against whom disciplinary charges were preferred on December 13, 2006 is hereby suspended without pay effective December 20, 2006 until completion of the hearing and determination on the charges.
