NOVEMBER 4, 2010
RESOLVED, the Town Board of the Town of Yorktown will hold a Special Meeting on Thursday, November 4, 2010 at 6:45 P.M. at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York 10598. This meeting will replace the Town Board’s regularly scheduled meeting that would have been held on Tuesday, November 2nd, 2010 Election Day.

PROPOSED FRANCHISE RENEWAL – CABLEVISION
NOTICE IS HEREBY GIVEN, that a public hearing will be held by the Town Board of the Town of Yorktown, at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York 10598 on the 4th day of November, 2010 at 7:30 o'clock PM, or as soon thereafter as the same can be heard, to consider the renewal of Cablevision Systems Westchester Corporation’s franchise in the Town of Yorktown.

NOTICE IS HEREBY GIVEN, that a public hearing will be convened by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York 10598 on the 7th day of December, 2010 at 7:30 PM, or as soon thereafter as the same can be heard, to amend Chapter 115 of the Code of the Town of Yorktown entitled “ANIMALS,” to establish a municipal dog licensing program and to amend fees related to the impoundment of dogs.

Bids were received by the Town Clerk on Thursday, October 14, 2010, for the above-referenced project and are summarized as follows:

RESOLVED, that the bid for Ferric Chloride be awarded to Kemira Water Solutions, the low bidder, at a cost of $560.00 per dry ton, and be it further

RESOLVED, that the bid for Ferric Chloride 37% to 40% be awarded to Slack Chemical Co., the sole bidder, at a cost of $184.29 per 55 gallon drum, and be it further

RESOLVED, that the bid for Caustic Soda 50% be awarded to Tridon Chemical Co., the low bidder, at their bid price of $2.12 per gallon,

Resolved, that the bid for Sludge Removal scheduled at the STP, is awarded to Spectraserv, at a price of $0.13 per gallon, and BE IT FURTHER

WHEREAS, Elizabeth Silverman, as applicant, provided the Town with Check No. 3371 in the amount of $1,000.00, to serve as the Erosion Control Bond for Excavation Permit #E-042-10, for the Elizabeth Silverman Subdivision located on Williams Drive; and

WHEREAS, all other monies related to the above referenced subdivision were accepted by the Town Board at their meeting of December 1, 2009; NOW, THEREFORE BE IT

RESOLVED, that the above referenced check is hereby accepted to serve as the required bond for the Silverman Subdivision.

BOND ACCEPTANCE – ALGONQUIN GAS
SPECTRA ENERGY - #WP-E-030-10
WHEREAS, Spectra Energy/Algonquin Gas, as applicant, provided the Town with Check No.0142563, in the amount of $2,500.00, to serve as the Erosion Control Bond for Town Board approving permit #WP-E-030-10, for gas pipeline work throughout the Town of Yorktown, and

WHEREAS, Spectra Energy/Algonquin Gas, as applicant, provided the Town with Check No.10142562, in the amount of $1.500.00, to serve as construction monitoring escrow fee, NOW, THERFORE BE IT

RESOLVED, that the above referenced checks are hereby accepted to serve as the required monies for the above referenced Wetland/ Excavation Permit.

BOND RELEASES – ROUTE 202
EROSION CONTROL BOND WP-009-89 / E-003-94
WHEREAS, Joseph Adrian, as applicant, heretofore filed an Erosion Control Bond in the sum of $5,000.00, which was deposited into the T33 account on June 19, 1987, to serve as the Erosion Control Bond for Wetland Permit #WP-009-89, for work performed at the Adrian Auto Mall site located on Route 202; and

WHEREAS, the above referenced Erosion Control Bond was reduced to $1,000.00 at the Town Board Meeting of December 18, 1990, Resolution #661, and transferred to Excavation Permit #E-003-94 for remaining work at the Auto Mall site and other Adrian property; and

WHEREAS, the Town Engineer has informed this Board that a representative of her Department has inspected the property and determined that the work has been satisfactorily completed, and that the $1,000.00 for Erosion Control may be released; NOW, THEREFORE BE IT

RESOLVED, that the above-described Erosion Control Bond in the amount of $1,000.00 be and is hereby released to Mr. Joseph Adrian, 2445 Mark Road, Yorktown Heights, NY 10598.

BOND RELEASE – CROW HILL RD.
EROSION CONTROL BOND WP-043-09
WHEREAS, Lori Juergens, as applicant, heretofore filed an Erosion Control Bond in the amount of $350.00, which was deposited into the T33 Account on October 16, 2009, covering Wetland Permit #043-09, for work performed at her Crow Hill Road residence; and

WHEREAS, the Town Engineer has informed this Board that a representative of her Department has inspected the property and determined that the work has been satisfactorily completed, and that the $350.00 for erosion control may be released; NOW, THEREFORE BE IT

RESOLVED, that the above-described Erosion Control Bond in the amount of $350.00 be and is hereby released to Ms. Lori Juergens, 459 Crow Hill Road, Yorktown Heights NY 10598.

BOND REDUCTION – GOMER STREET
YORKTOWN FARMS SUBDIVISION
WHEREAS, Val Santucci, as applicant, provided the Town with Hudson Valley Bank, N.A., Letter of Credit No. 707, in the amount of $1,094,062.00, to serve as the Performance Bond for the Yorktown Farms Subdivision, located off Gomer Street; and

WHEREAS, Val Santucci, as applicant, provided the Town with Hudson Valley Bank, N.A., Letter of Credit No. 711, in the amount of $40,000.00, to serve as the Erosion Control Bond for the Yorktown Farms Subdivision; and

WHEREAS, Val Santucci, as applicant, provided the Town with Hudson Valley Bank, N.A Letter of Credit No. 719 in the amount of $15,000.00 to serve as the Wetland Bond for Wetland/Excavation Permit #WP-E-010-08; and

WHEREAS, Val Santucci, as applicant, has requested his Performance & Erosion Control bonds be reduced as certain construction items are complete; and

WHEREAS, the Town Engineer has informed this Board that a representative of her department has inspected the property and determined public improvements, have met Town requirements, therefore, a bond reduction has been completed and all other securities held; NOW, THEREFORE BE IT

RESOLVED, that said Performance Bond, Letter of Credit No. 707 be reduced to $661,767.00 ($1,094,062-$432,295=$661,767.00) and, BE IT FURTHER

RESOLVED, that the Erosion Control Bond , Letter of Credit No. 711, in the amount of $40,000.00 remain in full force and effect; and BE IT FURTHER

RESOLVED, that all remaining monies will be held in full force and effect until all construction is completed.

AUTHORIZE SUPERVISOR TO SIGN AGREEMENT WITH JOHN J. BURKHARDT, ESQ. FOR LEGAL SERVICES TO DEFEND THE TOWN OF YORKTOWN WITH A TAX CERTIORARI CASE FILED BY ROC SHRUB OAK
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with John F. Burkhardt, Esq. for legal services to defend the Town in connection with a tax certiorari case filed by Roc Shrub Oak. The contract amount is $200.00 per hour plus disbursements and the term is for the duration of the case not including any appeals.

AUTHORIZE INTERIM TOWN PROSECUTOR
DANIEL L. PAGANO
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Daniel L. Pagano, Esq., for legal services to the Town to serve as Interim Town Prosecutor. The contract amount is $180.00 per hour plus disbursements. The term of the agreement is from June 15, 2010 until July 20, 2010.

FOR ADDITIONAL WORK AT PATRIOT GARDEN
WHEREAS the Town Board of the Town of Yorktown on September 9, 2009 awarded to
Cedar Hills Landscaping the construction of the Patriot Garden; and

WHEREAS said contract was awarded for a maximum amount of $ 168,078.00; and

WHEREAS Cedar Hills Landscaping has submitted additional expenses for required work:

Supply and Install 4,000 sf of erosion control mat along retention basin $ 2,000.00
Supply and Install 40 yards of 4-6 local rip rap stone $ 2,100.00
Supply and Install 4 plastic flared pipe ends (15 inch) $ 700.00
Supply and Install one precast catch basin, with concrete cover. Supply
and Install 40 lf of 15 inch poly.
Supply and Install two tons of asphalt. Salvage existing catch basin,
frame and grate $ 3,800.00
$8,600.00, and

THEREFORE BE IT RESOLVED the Town of Yorktown hereby authorizes payment for said expenses with an increased allocation of $ 8,600.00 for a total project cost of $176,678.00

RENEW CONTRACT FOR THE ENVIRONMENTAL CONSULTANT

ENDORSE APPLICATION TEATOWN LAKE RESERVATION
FOR A GRANT FROM NEW YORK STATE FOR TRAIL PROJECT
WHEREAS, Teatown Lake Reservation is applying to the New York State Office of Parks, Recreation and Historic Preservation for a grant under the Recreational Trails Program for a trail project to be located at 1600 Spring Valley Road in Ossining, a site located within the territorial jurisdiction of the Town of Yorktown; and

WHEREAS, as a requirement under the rules of these programs, said not-for-profit corporation must obtain the "approval/endorsement of the governing body of the municipality in which the project will be located";

NOW, THEREFORE, be it resolved by this august body that the Board of Yorktown hereby does approve and endorse the application of Teatown Lake Reservation for a grant under the Recreational Trails Program for a trail project known as Lakeside Boardwalk Project and located within this community.

DEDICATION OF PARKLAND

WHEREAS, Town Law Section 64 allows a town to acquire by purchase, in the manner provided by law any lands or rights therein, either within or outside the town boundaries, required for any public purpose; and

WHEREAS, the Town of Yorktown has come into the ownership of two parcels of property through open space purchase; and

WHEREAS, a review by the Town of Yorktown has determined that these properties are appropriate for parkland; and

WHEREAS, the Town Board finds that dedication of these parcels is in the public interest and is consistent with the Town’s policy with respect to the acquisition and preservation of parkland, be it
RESOLVED, the Town of Yorktown does hereby formally dedicate the following parcels as public parkland:
