Regulations, I-2 Planned Light Industrial Districts)
WHEREAS, the Yorktown Town Board has proposed a local law amending Chapter 300-21C (1) (Use Regulations, I-2 Planned Light Industrial Districts), adding a main use: Buildings for Staging Special Events to the Code of the Town of Yorktown.

RESOLVED, that the Town Clerk is hereby authorized to refer the Proposed Local Law to the appropriate agencies for their review and recommendations, and

BE IT FURTHER RESOLVED that the comments and recommendations relating to this proposed local law be forwarded to the Town Clerk on or before April 26, 2013, and

BE IT FURTHER RESOLVED, the Town Board declares its intent to act as Lead Agency, and

BE IT FURTHER RESOLVED, that the Town Board will hold a Public Hearing on this proposed local law at its meeting of May 7, 2013 to be held at John C. Hart Memorial Library, 1130 East Main Street, Shrub Oak, NY at 7:30 o’clock P.M. or as soon thereafter as same can be heard.

NOTICE IS HEREBY GIVEN, that a public hearing will be reconvened by the Town Board, Town of Yorktown, Westchester County, New York at the Town Hall, 363 Underhill Avenue, Yorktown Heights, New York on the 16th day of April, 2013 at 7:30 o'clock PM, or as soon thereafter as the same can be heard to amend Chapter 275 of the Town Code of the Town of Yorktown entitled “VEHICLES AND TRAFFIC,” to prohibit parking on Stony Manor Court.

WHEREAS, the Water Distribution Superintendent has prepared local bid specifications for the purchase of One (1) 2013 Ford Escape 4x4 Model SE and One (1) 2013 Ford Explorer 4x4 Base,

WHEREAS, the Town Attorney has reviewed these specifications,

NOW THEREFORE BE IT RESOLVED that the Town Board authorizes the Water Distribution Superintendent to advertise for competitive local bid for the purchase of One (1) 2013 Ford Escape 4x4 Model SE and One (1) 2013 Ford Explorer 4x4 Base.

NOTICE IS HEREBY GIVEN that sealed bids will be received by the Town Clerk, Town of Yorktown, Westchester County, NY until 11:00 A.M. on April 15, 2013 at the Town Hall, 363 Underhill Avenue, Yorktown Heights, N.Y. 10598 for Water Department Vehicle Purchase. Specifications may be obtained at the office of the Town Clerk in said Town Hall.

Bond Release:
#BSWPPP-065-12 – Pines Bridge Road
WHEREAS, Robert Manocherian, as applicant, heretofore posted Check No.5701 in the amount of $1,000.00, which was deposited into the T33 Account on December 5, 2012, covering Stormwater Permit #065-12, for work performed at his Pines Bridge Road residence, and

WHEREAS, the Town Engineer has informed this Board that a representative of her Department has inspected the property and determined that the work has been satisfactorily completed, and that the $1,000.00 for erosion may be released, NOW THEREFORE BE IT

RESOLVED, that the above-described Erosion Bond in the amount of $1,000.00, be and is hereby released to Mr. Robert Manocherian, P.O. Box 10562, 784 Pines Bridge Road, Yorktown Heights, NY 10598.

Budget Transfer
Be It Resolved, upon the request of Acting Town Engineer Sharon Robinson, the following 2013 budget transfer is approved:

Decrease: YS 8130.459 Infiltration Removal ($6,000.00)
Increase: YS 8130.418.002 Equipment Maintenance DEP +$6,000.00

• Requests from the Parks and Recreation Dept.:
Extend the license with Costa Foods, Inc. to have the food concession
at the Junior Lake and Shrub Oak Pool Complexes
WHEREAS, the bid for the Operation of Food and Refreshment Concession for the Yorktown Town Pools at Shrub Oak and Junior Lake was awarded on March 1, 2011 for the 2011 season to Costa Foods, Inc, and

WHEREAS, the contract agreement with Costa Foods, Inc. provides the License may be renewed for up to three additional one-year terms, and

WHEREAS, the Superintendent of Parks and Recreation recommends to renew the contract with Costa Foods, Inc for the second additional one-year term for the 2013 pool season

NOW, THEREFORE BE IT RESOLVED, that the operation of food and refreshment concession services at the Brian J Slavin Aquatic Center in Shrub Oak and the Junior Lake Pool in Yorktown Heights be awarded to Costa Foods, Inc. of 11 Lincoln Avenue, Rye Brook, NY 10573 for the amount of $7,850.00 for the 2013 pool season.

Authorize the Supervisor to sign a lease agreement with
Yorktown Community Nursery School for the Town of Yorktown’s
Pre-school summer camp program.
WHEREAS, the Town wishes to obtain space for a period of under one month in which to operate a pre-school summer camp program under the Department of Parks and Recreation,

NOW THEREFORE, BE IT RESOLVED, that the Town has determined the action contemplated under this Resolution is a Type II action under the State Environmental Quality Review Act (“SEQRA”) and therefore no further review is required under SEQRA; and be it

FURTHER RESOLVED, that the Supervisor is authorized to execute a lease agreement on behalf of the Town, as tenant, with Yorktown Community Nursery School, landlord, at 247 Veterans Road, Yorktown Heights, from July 1, 2013 through July 26, 2013, at a rent of $4,500.00, to be paid out of surplus funds, to provide facilities for the Parks and Recreation Department’s pre-school summer camp program.

RESOLVED, that Somers Sanitation D/B/A Bria Carting Inc. be and is hereby granted renewal of their garbage license for commercial properties only, for the year 2013.

• Requests from the Water Distribution Superintendent:
Accept the results of the on-line auction for vehicles and equipment
declared obsolete:
WHEREAS, on March 6, 2013 Auctions International, Inc., the Town’s contracted auctioneer went live with an online auction featuring thirteen of the Town’s surplus vehicles and items of equipment,

WHEREAS, on March 18, 2013, Auctions International closed the bidding process for all Town vehicles and equipment,

THEREFORE BE IT RESOLVED that the Town Board accepts the bids for the following thirteen (13) vehicles in the amounts shown.

Extend Annual Maintenance and Emergency On-Call service contract
for Boilers and Furnaces
RESOLVED, that the Annual Maintenance and Emergency On Call service for Town Boilers and Furnaces for the Town of Yorktown be herby extended for one year per the terms of the bid agreement to JFJ Fuel Oil/Valley Oil Company, 705 Nepperhan Ave, Yonkers, New York 10703.The date of the extension will be from January 1, 2013 through December 31, 2013.

Authorize the Police Chief to purchase vehicles off the County Bid:
RESOLVED, that the Yorktown Police Chief is hereby authorized to purchase
(3) three vehicles off of the Westchester County Bid to be used as marked and unmarked police vehicles..
