8. RESOLUTIONS

Request from the Supervisor’s Office:

            WHEREAS, by resolution of the Board of Fire Commissioners of the Yorktown Heights Fire District (YHFD”)  dated June 25, 2013, the YHFD has conveyed all right, title and interest in the 2003 Ford Expedition to the Town of Yorktown, 363 Underhill Avenue, Yorktown Heights, New York 10598 subject to the stipulated terms below.

The Town has inspected or has had a full and fair opportunity to inspect and operate the vehicle and, further,
That the apparatus is offered and accepted “as is” and “with all faults, if any”, known and unknown, and that the YHFD disclaims all express warranties and any and all implied warranties of merchantability or fitness for a particular purpose, and further,
That the YHFD is not a U.C.C. dealer in goods of this kind and, further,
That the vehicle is gifted by the YHFD and accepted by the Town on the express condition that it be put to its highest and best purpose in the service of the office of Fire Inspector of the Town to advance and support the duties of that office and, further,
That the Town shall bear all costs, inclusive of liability insurance coverage and the satisfaction of all municipal or state fees, if any, associated with the preparation, transfer, removal and transportation of the vehicle from the property of the YHFD until it is in the sole possession and control of the Town.

            BE IT RESOLVED, that the Town Board authorizes the Supervisor to sign the Certificate of Transfer of Ownership of the 2003 Ford Expedition (Vin # 1FMPU16L03LB7952)

9. PUBLIC HEARING

   To consider the request made by Tom McCrossan and Mark McGoldrick for a Special Use Permit to operate a Convalescent Home at 482 Underhill Avenue, Heights, NY
