Resolutions to be approved:

7. ADVERTISE BID – COPIER MACHINE MAINTENANCE CONTRACT
NOTICE IS HEREBY GIVEN that sealed proposals will be received by the Town Clerk of the Town of Yorktown, Westchester County, NY for qualified parties for Copier Maintenance and Supplies Contract.

All bids must be accompanied by an executed non-collusion bidding certificate.

Specifications may be obtained at the office of the Town Clerk at said Town Hall, Yorktown Heights, NY during regular office hours.

The bidder assumes the risk of any delay in the mail or in the handling of mail by the employees of the Town of Yorktown. Whether sent by mail or means of personal delivery, the bidder assumes the responsibility for having bids in at the time and the place specified above.

The Town Board reserves the right to reject any or all bids and to accept that bid which it deems most favorable to the interests of the Town of Yorktown.

8. RESOLUTIONS:

EXTEND BID FOR BODY WORK ON TOWN CARS
WHEREAS, bids for Bodywork on Town Cars were received and opened on February 2, 2010; and

WHEREAS, said bid was awarded to Tompkins Garage, Inc., 1440 Croton Lake Road, Yorktown Heights, New York 10598; and

WHEREAS, the town has the option to extend said bid for three additional years in one-year increments; and

WHEREAS, said bid commenced February 2, 2010 through February 1, 2011 with additional years of 2011, 2012 and 2013; NOW THEREFORE BE IT

RESOLVED, that the Superintendent of Environmental Conservation Patrick Lofaro hereby recommends to the Town Board that the Town exercise its option to renew the contract for one year, per the terms of the bid; and be it

FURTHER RESOLVED, the date of the extension will commence February 2, 2011 through to February 1, 2012.

MODIFICATIONS TO THE PEEKSKILL SANITARY SEWER DISTRICT – SMITH, J & STACHOWIAK, WM – BIRCH STREET
WHEREAS, the Westchester County Department of Environmental Facilities approved an out-of-district sewer connection to its Peekskill Sanitary Sewer District in October 2008; AND

WHEREAS, the Town of Yorktown Town Board is desirous of including 1 parcel of land into the existing Peekskill Sanitary Sewer District, NOW THEREFORE BE IT

RESOLVED, that the Town Board of the Town of Yorktown does hereby request that the County of Westchester incorporate parcel 27.09-3-35 (2886 Birch Street – Smith/Stachowiak) into the Peekskill Sanitary Sewer District.

APPROVE CONSULTANT REVIEW FEE FOR SANCTUARY GOLF COURSE

WHEREAS, drawings were referred by the Town Clerk on 02/04/11 for review and comment, and
WHEREAS, review will consist of identification of any natural resource impacts due to the construction including, but not limited to, wetland and wetland buffers, habitat, threatened and endangered species to the site as well as the immediately adjacent Turkey Mountain Preserve, and
WHEREAS, the anticipated work will be document review, site inspections and reports to the Town Board, and
WHEREAS, the anticipated hours of work will be six, at an estimated fee of $750, NOW, THEREFORE BE IT RESOLVED, that the Sanctuary Golf Course applicant post $750 in escrow for the above referenced scope of work.

EXTEND BID FOR BODY WORK ON TOWN TRUCKS
WHEREAS, bids for Bodywork on Town Trucks were received and opened on February 2, 2010; and
WHEREAS, said bid was awarded to Tompkins Garage, Inc., 1440 Croton Lake Road, Yorktown Heights, New York 10598; and
WHEREAS, the town has the option to extend said bid for three additional years in one-year increments; and

RESOLVED, that the Superintendent of Highway Eric DiBartolo hereby recommends to the Town Board that the Town exercise its option to renew the contract for one year, per the terms of the bid; and be it
FURTHER RESOLVED, the date of the extension will commence February 2, 2011 through to February 1, 2012.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – JEFFERSON OWNERS FOUNDATION TRAVEL CLUB
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Jefferson Owners Foundation to provide a recreational travel program for senior citizen residents of the Town. The contract amount is $2,100.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – AARP CHAPTER 3297
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with AARP Chapter 3297 to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – NEW HORIZON SENIORS
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with New Horizon Seniors to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – SHRUB OAK SENIOR CLUB
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Shrub Oak Senior Citizens Club to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – SAINT PATRICK’S SENIOR CLUB
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with St. Patrick’s Seniors to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – YORKTOWN SENIORS CLUB CHAPTER 1
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Yorktown Senior Club Chapter 1 to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN - SENIOR CONTRACTS – YORKTOWN SENIORS CHAPTER 2
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Yorktown Chapter 2 to provide recreational programs for senior citizen residents of the Town. The contract amount is $2,700.00 to be paid in a single lump sum and the term of the agreement shall be from January 1, 2011 to December 31, 2011.

AUTHORIZE SUPERVISOR TO SIGN AGREEMENT – METROCOM WIRELESS, INC.
RESOLVED, that the Town Supervisor is hereby authorized to sign an agreement with Metrocom Wireless Inc. for a maintenance agreement covering Yorktown Police Department’s Motorola two-way radios through January 31, 2012. The contract amount is $260.00.

AUTHORIZE SUPERVISOR TO RETAIN THE LAW FIRM WORMSER, KIELY, GALEF & JACOBS, LLP – THE TOWN OF YORKTOWN IN THE MATTER OF CARJEN FENCE CO., INC. V. TOWN OF YORKTOWN
RESOLVED, that the Town board authorizes the Town Supervisor to retain the law firm Wormser, Kiely, Galef & Jacobs, LLP to represent the Town in the matter of Carjen Fence Co., Inc. v. Town of Yorktown (Sup. Ct. Westchester County Index No. 14073/2007), in accordance with the terms of the retainer agreement with Wormser Kiely dated March 15, 2010, plus disbursements.

APPROVE COMMERCIAL GARBAGE LICENSE FOR 2011 – CRP SANITATION COMPANY
RESOLVED, that CRP Sanitation Company be and is hereby granted renewal of their garbage license for commercial properties only, for the year 2011.

APPROVE COMMERCIAL GARBAGE LICENSE FOR 2011 – MID HUDSON WASTE
RESOLVED, that Mid Hudson Waste be and is hereby granted renewal of their garbage license for commercial properties only, for the year 2011.

APPROVE COMMERCIAL GARBAGE LICENSE FOR 2011 – ROGAN BROTHERS SANITATION
RESOLVED, that Rogan Brothers Sanitation be and is hereby granted renewal of their garbage license for commercial properties only, for the year 2011.

MAKE A PROMISE DAY
Whereas, Make a Promise Day is the only unofficial “holiday” dedicated to personal empowerment, goal achievement and integrity enhancement,
Whereas, Make A Promise Day encourages individuals to turn important goals into heartfelt promises thereby increasing the probability of reaching those goals;
Whereas, celebrating Make A Promise Day will have the effect of enhancing accountability, personal responsibility and integrity;
Whereas, the Town Board recognizes the value of highlighting the power of making and keeping promises on the part of local students, teachers, community organizations, businesses and political leaders;
Now therefore be it resolved, that the Town Board of Yorktown hereby designates and proclaims May 4th of 2011 and each year thereafter to be “Make A Promise Day” and encourages local organizations and individual members of the community to celebrate “Make A Promise Day” in a manner they deem to be suitable and appropriate.
