Appointment Building Inspector
BE IT RESOLVED, that John P. Winter of Katonah, NY, is hereby appointed Building Inspector, job class code 0518-01, effective July 5, 2011, to be paid $100,000.00 annually, with four weeks of annual vacation, and for other benefits, sick days, personal days, and floating holidays to follow the CSEA agreement,

BE IT RESOLVED, that John P. Winter will have the use of a Town vehicle to take home, which can only be used when conducting Town business,

BE IT RESOLVED, contingent upon successful completion of a drug test,

BE IT RESOLVED, that John P. Winter will report to work at the Yorktown Building Department on July 18th, 2011, and this date will be used as the first date of appointment,

BE IT FURTHER RESOLVED, that this appointment is subject to a probationary period of not less than 12 nor more than 52 weeks, commencing on the first date of appointment on July 18th, 2011.

8. PUBLIC HEARING
Proposed local law amending various sections of Chapter 300-Section 161 Lot and bulk standards
NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board, Town of Yorktown, Westchester County, New York at Sparkle Lake Park located at 176 Granite Springs Road, Yorktown Heights, NY 10598 on the 5th day of July, 2011 at 6:00 o'clock PM, or as soon thereafter as the same can be heard, to consider a proposed local law amending various provisions of Chapter 300 of the Code of the Town of Yorktown entitled “ZONING” with respect to Article XVI entitled “Age-Oriented Geriatric Community.”
SECTION I. Deleting the first paragraph of Section § 300-161. Lot and bulk standards and replacing it with the following:

The following standards are designed to promote a physical development of low structures (maximum of three floors) set in large open spaces with ample setbacks from adjacent property. The proposed Floor Area Ratio (FAR) is 0.21, which is suitable for a medium-density suburban area or location. The allowable density is related directly to the assumed mobility of the facility's residents, i.e., a lower density is prescribed for the residential care facility than for the nursing home. The proposed density for the congregate housing is similar to that of the Town's multifamily district (R-3). For a combined facility, the density shall be calculated on the basis of the requirements of each use.

SECTION II. Deleting Section § 300-161 (B) in its entirety and replacing it with the following:

B. Allowable maximum density. The following densities are permitted in areas where public water is available and where a waste disposal method other than public sewers is proposed.
SECTION III. Deleting Section § 300-161 (C) (2) in its entirety and replacing it with the following:
(2) Maximum building height: 42 feet.

A copy of said proposed local law is on file in the office of the Town Clerk, at the said Town Hall, where the same may be inspected during regular office hours.

All persons in interest and citizens may be heard at the public hearing to be held as aforesaid.

NOTICE IS HEREBY GIVEN that sealed proposals will be received by the Town Clerk of the Town of Yorktown, Westchester County, NY until 1:00 PM on Monday, August 1, 2011 at the Town Hall, 363 Underhill Avenue, Yorktown Heights, NY 10598 for the purchase of One (1) 2012 Mack Granite GU813 Chassis and One (1) Leach 2Rlll 25 cubic yard high compaction heavy duty rear loading body for use in the Environmental Conservation Department.

All bids must be accompanied by an executed non-collusion bidding certificate.

Specifications may be obtained at the office of the Town Clerk at said Town Hall, Yorktown Heights, NY during regular office hours.

The bidder assumes the risk of any delay in the mail or in the handling of mail by the employees of the Town of Yorktown. Whether sent by mail or means of personal delivery, the bidder assumes the responsibility for having bids in at the time and the place specified above.

The Town Board reserves the right to reject any or all bids and to accept that bid which it deems most favorable to the interests of the Town of Yorktown.

10. RESOLUTIONS
Authorize Harold Girdlestone, the Town of Yorktown Assessor to attend the New York State Assessors 2011 Annual Training Conference at Cornell University
Resolved, that Harold Girdlestone, the Town of Yorktown Assessor, be granted approval to attend the New York State Assessors 2011 Annual Training Conference at Cornell University, July 18 thru July 22, on town time and no cost to the Town, to satisfy annually required continuing education credits.

Landscape Bond Release Munsell – Cranberry Lane
WHEREAS, Daniel Munsell, as applicant, heretofore filed Landscape Bond #2345 in the amount of $300.00, for Lot #1.9 on Cranberry Lane, which was deposited into the T-30 Account on January 7, 2010, and

WHEREAS, the Town Engineer has informed this Board that a representative of her Department has inspected said property and determined that the work has been satisfactorily completed, and that said bond totaling $300.00 may be released, NOW, THEREFORE, BE IT

RESOLVED, that the above referenced Landscape Bond totaling $300.00, be and is hereby released to Mr. Daniel Munsell, 20 Kramers Pond Road, Putnam Valley, NY 10579.

Set the price for a new 18 gallon recycling bin
RESOLVED, effective immediately, the Town Board approves that the prices for Recycling Bins offered for sale by the Environmental Conservation Department are:

14-gallon Recycling Bin: $ 6.00

18-gallon Recycling Bin: $ 8.00

Release of Escrow Deposit: Driveway Permit #1181 - $500.00
WHEREAS, a representative of the Highway Department has made an inspection of the following site and found the work to be completed satisfactorily.

NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes the release of the following Escrow Deposit:

Authorize the Receiver of Taxes to remove liens from parcels 16.10-1-47.11 ($1,808.40) and 16.10-1-48.11 ($532.60) (road and road widening strip)
WHEREAS, the two parcels identified on the Town’s tax maps as section/block/lot 16.10-1- 47.11 and 16.10-1-48.11 were dedicated to the Town as roads and/or road widening strips by the prior owner and the dedication was accepted by the Town in 2006 upon the delivery of a deed and the parcels were duly removed from the tax rolls in 2006; and

WHEREAS, the records of the Tax Receiver indicate that parcel 16.10 1 47.11 is subject to tax liens for the tax years 1999 through 2006 totaling $1,808.40, and parcel 16.10-1-48.11 is subject to tax liens for the tax years 1998 through 2006 totaling $532.60, which liens were imposed against the prior owner or owners; and

NOW THEREFORE, be it resolved that the Town Board finds that the liens on parcels 16.10 1 47.11 and 16.10-1-48.11 are uncollectible, and directs and authorizes the Tax Receiver to remove said liens from the Town’s tax records.

Authorize the Supervisor to execute a contract with Big Wave Event Productions in the amount of $3,400 to provide the equipment and personnel to screen the outdoor movie on July 14, 2011
RESOLVED, the Town Board authorizes the Town Supervisor to execute a contract with Big Wave Event Productions, LLC, PO Box 188, Roxbury, CT 06783 in the amount of $3,400.00 to provide equipment and personnel (Big Surf Drive-In Mega System) to screen an outdoor movie on July 14, 2011 or a mutually acceptable rescheduled date in the event of inclement weather. Execution of the contract shall be subject to approval of the Town Attorney of the contract terms and contractor’s insurance certificates.

Refund – Water Account #44-03480008 - $219.01
RESOLVED, that upon recommendation of Cliff Kummer, Northern Westchester Joint Water Works a refund in the amount of $219.01, Account #44-03480008 over payment be and is hereby refunded to GiGi Pizza, Inc., P.O. Box 444, Jefferson Valley, NY 10535.

Authorize the Supervisor to sign an Agreement and Claim with Westchester County Department of Senior Programs and Services for a one time grant amount of $20,000
Resolved, that, subject to prior review and approval of the Agreement and Claim Form by the Town Attorney, the Town Supervisor is hereby authorized to sign an Agreement and Claim Form with Westchester County Department of Senior Programs and Services for a one-time grant in the amount of $20,000 from the New York State Community Services for the Elderly Program to help defray the additional costs incurred for the Nutrition Program. This grant covers the period April 1, 2010 through December 31, 2010.

Be it resolved, that the Town Board hereby authorizes (3) police officers to attend the “School resource Officer Essentials Course”, scheduled for August 29-Septemebr 2, 2011 in White Plains, NY.
